I-94s are submitted at the airport when you leave the country. In many cases there are no I-94s coz they have been submitted and no one thought of making copies of them before travelling out of country. I am sure I dont have all the I-94s that I ever used. I submitted them at the airport when I went out and didnt make copies.

I think it must be ok if you dont have all of them. Can anyone advise if that's the case?
You dont need all I-94's. They only need the last I-94. But, you will need to give copies of all the H1B visa petition. For instance, if you changed your employer then you will have new petition or even when you extend your visa.

Why would you want to do that? I am EB-2, waiting for GC but don't consider myself to have some sort of monopoly over EB-2.

EB-2 or EB-3 is not our birthright. It's just a matter of circumstance that many of us found ourselves in one category or other. It does not even necessarily mean any difference in skill or experience. There are many people in EB3 with Masters degrees and many people with over 10 yrs experience.

Dude everybody wants their GC. If you want to fight injustice fight for something positive. You will only get bad Karma by undercutting other people

JUAN GONZALEZ: No, exactly. And I have a different perspective on that

    LOU DOBBS: Sure.

JUAN GONZALEZ: So youll indulge me.

    LOU DOBBS: Sure.

JUAN GONZALEZ: But the fact is that immigration policy in this country has always been a means of rallying anger among the public.

    LOU DOBBS: Oh, nonsense.

    JUAN GONZALEZ: Yes, it has.

    LOU DOBBS: Nonsense.

JUAN GONZALEZ: Lou, let me finish.

    LOU DOBBS: First of all

JUAN GONZALEZ: Let me finish, Lou, please.

LOU DOBBS: Ridiculous. But, alright, go ahead.

JUAN GONZALEZ: The Chinesein 1882, the Chinese Exclusion Actwhat was the claim against the Chinese, small population of Chinese immigrants? The claim was that they were involved in drugs, that they were bringing crime, that they were a danger to the country, and the country passed in 1882 a Chinese Exclusion Act. The same thing in the 1920s.

LOU DOBBS: Are you holding me responsible? Or are

    JUAN GONZALEZ: No, no.

LOU DOBBS: Because I cant find germane or relevant point there.

JUAN GONZALEZ: What Im telling you is that this has been done over and over again. This has been done over and over again. And precisely

LOU DOBBS: Juan, according to you

JUAN GONZALEZ: Let me finish, Lou. Precisely becausebecause the country is an immigrant nation, its easy to divide the people along ethnic and racial lines over the issue of immigration.

LOU DOBBS: Youre the only one doing it.

JUAN GONZALEZ: Over the issue of immigration.

LOU DOBBS: Youre the only one doing it.

JUAN GONZALEZ: No, Im not. No, Im not.

LOU DOBBS: Youre socio-ethnocentric to the point of absurdity.

JUAN GONZALEZ: You know very well that 75% of the undocumented immigrant population in this country comes from Latin America. And not only that, 65% comes from one country: Mexico.

    LOU DOBBS: That is right.

JUAN GONZALEZ: So the crux of the illegal immigration problem in the United States is the question of Mexico and the United States

    LOU DOBBS: Correct.

JUAN GONZALEZ: and the relationships between Mexico and the United States. Mexicans are the larger source of immigration to this country from any nationality.

LOU DOBBS: What is your point?

JUAN GONZALEZ: So that the question is that there is a huge disparity between the economic levels in Mexico and the economic levels in the United States. And you have properly said many times on your show that American companies are creating the problems, rather than helping to alleviate the problems. All that would be needed to do is to raise the economic level in Mexico and the entire illegal immigration population problems would decline in this country. And not only that, but the country, if it had a higher immigration quota in connection with

LOU DOBBS: Are you giving me instruction, or are you telling me what we agree upon?

JUAN GONZALEZ: No, we dont agree. We dont agree, because you are demonizing illegal immigration as a separate issue, rather than dealing with the realities that Mexico and the United States must find a way to build better closer economic ties and raise the levels for both countries.

LOU DOBBS: Your view isas I take it, you and Amy believe that if we just had more illegal immigration, the crime rate would drop and the economy would boom in this country.

    JUAN GONZALEZ: No.

LOU DOBBS: Thats, on its face, absurd.

    JUAN GONZALEZ: No.

LOU DOBBS: Secondly, I have, over theover five years in reporting on this issue, repeatedly pointed out that the investment in Mexico by the United States has been paltry and absurd and diverted to China, instead of to this hemisphere, and particularly Mexico. The results could have been quite different. So when you talked about these issues, youre preaching to the choir, and you know that. The fact that you would focus on a couple of reports on tuberculosis, leprosy, the issue of the CCC in a flashwhat amounts to a flash frame, folks

AMY GOODMAN: And all the guests connected to it since.

LOU DOBBS: And all of those guests. How many would you say? Five?

AMY GOODMAN: Oh, I can keep going. I just thought

    LOU DOBBS: I would like

AMY GOODMAN: I should give someone else a chance here to have

LOU DOBBS: No, really, I think you should keep going, because the reality is, illegal immigration in this country is not going to be overwhelmed by this nonsense. The reality is, the Southern Poverty Law Center is an advocacy group right now. The ADL is an advocacy group right now. Pro-illegal immigration, pro-open borders, both of you, ideologicallyI understand that, and I can deal with that.

But the reality is, there is such a thing as the national interest. There is such a thing as the common good. And its not ethnocentric. Its not group and identity politics. Its all about this country, because this political system makes this economy possible. And the fact that people are starving in Mexicoand my heart goes out to themthe reality is there are five-and-a-half billion people in the world who are more impoverished than those folks in Mexico. And that land bridge does not give Felipe Calderon or Vicente Fox or any other group of activists the right to dictate the US immigration policy. Thats the reality.

Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.

Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.

INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.

It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

if a change in interpretation is done intentionally, then USCIS admits they were allotting visas incorrectly during the previous years...if it were a public company, lawyers would be climbing over one another to file a class action suit...unfortunately all we can do is write letters, make phone calls and pray

Not sure i agree with that statement. The way the spillover trickle is reaching EB2 there is no way EB2 will become current for atleast 5 years so impact on EB3 within a year or two is a incorrect statement

If the momentum continues, EB2 will be current in about 2 - 3 years. There are roughly 15 - 18K EB2 I applicants per year and around 5 K for EB 2 C. the number will defnitely be less during later part of 2008 to mid 2010 due to Economic downturn.

    The current queue for EB I + EB C till Aug 2007 ~ 36 K

People here are talking about 38 K SOFAD whcih means by August this year it will catch up August 2007, by late next year it should reach Aug 2009 and by late 2013 it will be current.

Again, all these based on assumption that the current momentum continues and the assumed 38 K SOFAD are available every year.

    Diana,

It makes sense to file concurrently only when PD is current. Otherwise it is like applying for your citizenship before getting your GC!

In other words I do not understand why your lawyer wants you to file concurrently when your PD is not current. Just to collect his fees? Maybe. He is at least right aboout the fact that USCIS will do nothing with your I485 application unless your PD is current. So I would just wait till your PD is current. You can still file for your I140 and wait for that to get processed.

    Regards,
    PH

I am not an attorney, so you will appreciate that any reliance is at your will.

fill the form and send it...also be a little technical...mention that the I-9 requires the proof of xxxxxx documents, with I-765 Employment authorization document being one of them.

Tell them you are a US worker as per the definitions laid out by the dept of Labor. Mntion that while you do have a H1B visa, which makes you a temporary worker not subject to the citizenship status discrimination prevention provisions, you are currently adjusting your status to a permanent resident and are availing yourself of the provision of I-765, thereby being a legal US worker as defined by the DOL and thereby would avail of the protection provded to you under the anti-discrimination provision of the Immigration and Nationality Act, 8 U.S.C. 1324b.

    Sledge_Hammer:
I agree with you the whole thing was set for a collapse and personal responsibility and other ethos have disappeared long time ago. In my opinion the fundamental problem is money created from debt. The backbone of entire modern economic system is based on creating money from debt. Check out this and you will know how leveraged the entire system is (not just real estate).
    http://video.google.com/videoplay?docid=-9050474362583451279

Unfortunately we are all caught in it with only solution to fix is time travel and kill the beast in infancy. There is vested interest by the Govt and Banks to lend because that's the only way money is created. That explains constant rate cut cycle and stimulating artificial growth. The entire monetary system is hijacked by banks. The debt to ordinary people drives the economy and people pay that debt and interest a good part of their life. Thus collapse of big banks could lead to eventual meltdown of the system, and no wonder govt keeps bailing them out.
In the end personal level frugal living and debt free people are constantly punished by taxing interest like ordinary income and no tax breaks. On the other hand big over leveraged spenders are rewarded with big tax breaks. Why ? Because it allows the well-oiled machinery to work.

In last 10-12 months, this overworked (overstretched) machinery broke down because the debt (and interest) is no longer paid back. Banking system of the entire countries start to fail (Iceland, Latvia, Hungry...). What happens next is anybody's guess, but we will be collateral damage, mine and your savings will be eroded by diminished buying power due to currency printed to bail out the fundamentally flawed system.
The sharp decline in moral and ethics is a direct result of entitlement mentality and welfare society. People feel that they deserve everything without having to pay it back and everyone who is better off must be evil. They forget that simple hardworking people can be rich by simply living debt free and with in the means.
Finally the money from debt driven system might survive but not without huge decline in standard of living, a massive recession and permanent shift away from material possession as a central theme of life.

It would have been ideal if they mandated 1:5 ratio. Unfortunately, with lax lending standards and unregulated banking, people made almost zero down payment (instead of the normal 20%) and bought into loans they couldn't afford in the first place.

I would still blame the borrower 95% for all the mess.

Can you please state the source of ur information.
The contents of this postings are based on what I have read from various Lawyer's website and my lawyer's suggestions.

    Multiple I-485 Fillings Scenario:

    1. Two I-485 for the with the same primary applicant

Case a: One I-140/I-485 Pending with another employer and one I-140/I-485 to be filed in July with the current employer.

Case b: One I-140/I-485 Pending due to substituted labor (and cannot be expedited because premium processing not available). Another I-485 to be filed based on approved I-140 (on one's own labor). Both from the same employer.

    2. Two I-485 with different primary applicants (Primary on one and dependent on other)

Case a: I-140 for one is approved while other's pending
    Case b: Both I-140 Approved
Case c: Both filling concurrently in June

    Pros and Cons
Scenario 1, Case a: In this case there is a substantial risk that I-485 filed with first employer might lead to issues esp if I-140 is not approved. Thus is a good idea to file another one with current employer. (Pro)

Scenario 1, Case a: How can one Adjust the Status from two employer at the same time. (Con)

Scenario 1, Case b: Since first I-485 application is already filed and I-140's outcome is not known. It is a good idea to file another one as a fall back option. If one waits for the outcome of first I-140 and it is denied and then it will be too late to file another I-485 because dates might have retrogressed.

Scenario 2, Case a: One with the approved I-140 should file I-485 with other as dependent.

Scenario 2, Case b: I-485 for both is almost ensured and thus filling two will give added cover in case something happens. One might have a better priority date than other. (Pro)

Scenario 2, Case b: Job loss of one would still allow other with AC-21 benefits. (Pro)

Scenario 2, Case b:Only one of the two partners has to stick to the job description and other is free to pursue anything (including studies).

Scenario 2, Case c: Use I-140 Premium Processing on at least one application for added certainty.

    Summary of Pros and Cons
    Pros:
    1. More flexibility as there are two applications to fall back on.
    2. Only opportunity to file EAD/AP before retrogression kicks in.
    3. Useful if I-140 is pending and outcome of it is unknown.
    4. There are NO USCIS memos that prohibits such filling explicitly.
    5. Many lawyers have recommended this as a best option.
    6. It has been mentioned that USCIS cancels the second I-485 after approving the other. That makes this a hassle free option.
    7. If there are issues with multiple filling one of the application can be withdrawn.
    8. If later on it turns out two application is a norm and right thing to do and retrogression hits one has no one to blame but himself.

    Cons:
    1. Cost of two fillings (if paid by self)
    2. There have been indications by lawyers that two fillings could lead to unnecessary delays and interviews.
    3. Apart from delays there has been indications that USCIS might issue an
RFE and ask to choose one.

    Conclusion
    ========
There is nothing wrong with two filings, worst case scenario could be an RFE from USCIS to choose one. Best case scenario is USCIS upon approving one cancels other. Two filings indeed give you a peace of mind and reduce risk during the process. It doesn't change the outcome (like your application will not be denied just because you have filed two). If a little delay is acceptable to you as a price you pay to reduce a bigger risk and added benefits then multiple filing is right thing to do.

    Kumar1,
I support your view. Let this punjabi guy go into foreclosure and screw up his credit history and suffer for the next 7 to 14 years. Its not just him, his entire family will suffer because of this.

Those who oppose the foreclosure, i think you guys are indirectly helping this punjabi guy. He has good job, good salary and he is capable of paying his monthly mortgage and he and his family are sleeping without any issue right now. If he is not going into foreclosure then how do you think this guy will suffer for the next 7 to 14 years?

Let his choose what he wants.

Punjabi guy, you are a greedy person and you have crook'ed mind. You know you are capable of paying off your monthly mortgage and still you want to foreclose your house? Don't you have ethics, moral values? Don't you think you are trying to cheat the system?

I know foreclosure is not bad and its not against law. But who should seek foreclosure? Is it not for people who are really really in deep trouble?

Even i own a house and i don't live there because of my job situation. I have rented out my house. I live 700 miles away from my own house. My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.

Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.

I was amazed to hear about the development. Would Mr. Gonzalez will show a curtsey to personally reply to all the people who sent flowers, and apolozise for the pain and emotional trauma his agency has caused to thousands of legal immigrants in this country ?

BTW, couple of years ago one of my American (citizen) friend was dealing with USCIS (at that time INS) to adopt a baby from China. When she got the baby after struggling for 4-5 years and with a push from local congressman, she was agahst with the way USCIS treated her. I still remember her remarks "If they do not understand the pain and suffering of a mother, and they do not care for a suffering orphan child, I highly doubt that they have any more humanity left in them".

The name has changed but the public face of the agency remains the same. Please remember that for them we are not human's, we are just file numbers sitting and rotting at their service center's.

So when USCIS decided to forward the flowers to our soilders (which we think is an excellent idea), its not because the agency has a human touch in it, but its because they found an excellent face saving mask for their unjust action.

I agree we should focus on the task. There are lot of people trying to mislead and take the discussion off track. I will draft my own letter and send it this weekend. Its better if everyone writes there own letter. EB3 guys wake up and do something.

Please share your draft so everybody can use it.

EB3: Please dont' loose focus from what EB2 people are saying. Since the new law favors them, they are trying to misguide us here.
