    My cousin has I-20's from Universities A and B.he got F1 Visa with University A's I-20.
    He is in India and he wants to go to University B.

    Could anybody tell if he can directly go to University B and complete the transfer process from there? or does he need to go to University A, complete the transfer process and then go to University B?

    does it create any problems at Port of Entry ?


    PS: I have not started GC process yet. So, I didn't update my profile.

    He could have done that few years go but not now. The rules have changed they have a system called SEVIS(post 9/11) and he has to go to the same university for which he has got the stamping and once he joins them and completes a semester or two he can transfer to the new school by following the procedure.

    Hi, I know this question is being asked by many people. I am sorry, but still confused. My situation is:

    EB3 - Labor filed - Aug, 2004 - BackLogged - Philadelphia - 45 day letter - Replied
    EB2 - Labor filed - Nov, 2005, Approved, I-140 filed - Mar 2006 - Approved.

    Can I continue using EB3, once Labor Approved anbd I-140 Approved, can I use that PD to my EB2? The job description is definately different on EB3 and EB2. Still can I use the EB3 PD on to EB2?

    Gurus, Please advise.

    what about if one changes jobs on AC-21 and then gets married and later wants to file 485 for wife?

    Is anything needed from the old employer?She is not getting married to your employer?:D No, nothing is needed from employer for dependent filing. He/she is your dependent - that's it. Just show that you filed I-485 and show relation between you.

    Me and my wife are July 2007 filers. We applied for Ead renwal.
    My wife started her own business and opened a LLC.
    Which means she is using her EAD. But how does the USCIS know that she is using her EAD.
    My question is when she aplied for the business license , she has given her SSN everywhere but how does the agencies know that this particular person is using EAD

    Pls let me know

    AFAIK they dont know unless USCIS issues an RFE for tax returns. What was her status before she filed her 485?
    Also why are you concerned whether they know or not?

    If we were able to get the 3 year visa rather than 1 year extensions, then the main problem that the BEC give us in a practical sense is that if we change jobs we loss our priority dates.

    So while the slow processing is an administration issue, the law could allow for priority dates to be kept something like this:
    "If a labor application has been pending for longer than [some time] then as of [some date], the applicant immigrant is able to keep the priority date of the original labor application whether or not the application is later withdrawn or disapproved."

    This in combination with 3 year extensions would give people freedom to either refile for PERM with same employer or move jobs and file for PERM with a new employer.

    Another solution would be to allow DoL to accept a large fee for premium processing. Making the fee large would have the effect of not too many using it and thus not overwhelming DoL, but it also might generate sufficient income to apply more resources to the remaining outstanding applications, and benefiting all while being practical.

    I recently received an inquiry at my San Francisco immigration law office from an "employer" who recently discovered that a person whom he had hired as an independent contractor was in the United States illegally. The employer had not originally known that the "employee" was illegal because independent contractors are exempt from the requirements of the Immigration Reform and Control Act (*IRCA*) (https://www.oig.lsc.gov/legis/irca86.htm) that require an employer to verify that an an employee is authorized to work in the United States. The "employer" wanted to explore the options of legalizing the contractor. While thinking about the options, I became interested in how the law defines an independent contractor.

    According to 8 Code of Federal Regulations Section 274a.1(j) (http://www.californiaimmigrationlawyerblog.com/8cfr274a.1.pdf) an independent contractor is an individual or entity who carries on an independent business, contracts to do a piece of work according to their own means and methods, and are subject to control only as to results.

    The decision of whether or not someone is an independent contractor is determined on a case-by-case basis. Factors to be considered include whether the individual or entity:



    supplies the tools or materials;
    makes services available to the general public;
    works for a number of clients at the same time;
    has an opportunity for profit or loss as a result of labor or services provided;
    invests in the facilities for work;
    directs the order or sequence in which the work is to be done and determines the hours during which the work is to be done.


    I began to wonder if people used independent contractors to get around the IRCA requirements. Apparently Congress thought about that as there is a regulation which states that an "employer" may not avoid the requirements of IRCA by hiring an independent contractor if a person or entity knowingly uses a contract or subcontract to obtain labor or services of an unauthorized alien. 8 C.F.R. �274a.5 (http://www.californiaimmigrationlawyerblog.com/8cfr274a.5.pdf).

    Hello,
    According to my knowledge the majority of name checks submitted are electronically checked and returned to the submitting agency as having "No Record" within 48-72 hours. The processing time for FBI name checks usually take from 30-120 days but timing does vary from case to case. The FBI�s intention is to have all visa requests processed within 120 days. Most name check requests that are over 60 days old are the result of the time required to retrieve and review field office record information. Any case which is not processed within this time frame is usually delayed because of a potential "hit" which will be further reviewed manually.

    I am a resident working on H1b. Got married and wife joined me in July 2010.

    1. First question in the ITIN form w-7 is: Reason you are submitting Form W-7. (there are couple of options)

    Is the option in my case: "Spouse of U.S. citizen/resident alien"? (and it asks for the resident's i.e. my name and SSN.)

    2. Item 6d. "Identification documents submitted" ?
    Options are for passport, Divers License, USCIS documentation.

    My wife has all the three. Her H4 visa is stamped and valid. What all should I submit?

    My emp. filed H1 ext in Jan 2011 and got RFE.

    My (existing) H1 extension is expiring on 25th March... which is just less than a week away.
    and my employer may submit RFE documents in First week of May...

    What would be my legal status during this period?

    My H1 extension was filed with regular processing, Is it advice able to upgrade it to premium while or before submitting the RFE docs?

    Please advice.

    I anticipate an inevitable situation arising out regarding my parents' health, that would require us to move back to India sometime in 2007. My EB2 NIW PD is Dec 2004. Does somebody out there with knowledge about issues and procedures connected with transferring from AOS application to Consular processing in India?

    You can change from AOS to Consular Processing. It's the other way around that's not possible. I wish your parents a speed recovery of their health.

    My PERM (EB2) was filed mid January 2008, less than 365 days before my second term H1B will expire in October 1, 2008. The case was audited in March and we responded in April 2008 to the Atlanta Processing Center. Since then, no news.

    From what I understand from my lawyer, there will be a time gap when I will be without H1B status between October 1, 2008 and mid January 2009, when I will be eligible for an automatic H1B extension due to the PERM pending for more than 365 days. This time gap comes to a total of about 110 days.

    My lawyer suggests spending these 110 days out of the country before October 1st, so they can be filed as a �time recap� and added to my H1B October expiration date. As a result, this would get me to mid January 2009 for the H1B visa extension, so I can stay continuously in the US.

    As of now, I already accumulated about 60 days � all from vacation during the 6 years on H1B. If I applied this for time recap, it would get me through December 1, 2008. If I can avoid it, I would rather not spend the remaining 50 days abroad before my H1B visa expiration.

    Questions:
    Recap eligibility
    - Does paid vacation count as time out of the country for recap filing and added to the H1B expiration date?
    - Do travel dates also count or only full days abroad?

    Recap filing
    - If the recap filing of 60 vacation days get me to December, can I still go in and out of the country between October and December -- even though my H1B officially ended in October?
    - Can I do a recap filing several times for time periods that I might stay out of the country between October and December, so eventually it would get me to mid January, the date when the H1B extension can be filed?

    Filing after PERM approval
    - What are the next filing steps if I get my LC approved before / after October or December?

    My lawyer, hired by my employer, keeps me in the dark. Is my information correct? Are there any work-arounds?

    I need to stay in the country, regardless of the filing fees or other costs. Which other filings are required and when, so I can stay continuously in the country?

    Thanks for any tips and advice.

    Is it right?I am working on EAD, if it doesnt come in time any ideas about the FAX # which you need to send your request? I have already opened an expedite request for my EAD by calling USCIS customer service, I just need the fax # and the cover letter format. I heard that even if you take an info pass appointment, they dont issue an interim EAD , is that correct?
