Visa Bulletin mentioned they did this in according to the requirements of Section 202(a)(5) of the Immigration and Nationality Act. But actually this might be a misunderstanding of Section 202(a)(5) and Section 203(b) - There is NO words in the act on how to allot unused visa # to differnt categories. Even the country limit and category limit would not apply if there are unused visas #. The allotment Mr. Charles Oppenheimer did horizontal spillover caused longer and more backlogs of EB3.

The interpretation of the intent of the law by USCIS is flawed and should be reconsidered given the enormous backlogs in various categories.
1. If the people are allowed to move between the categories it will just move the backlog from one line to another penalizing the ones already in that line.
2. It does not provides an equal opportunity to the people already in that line to move to other category who are patiently waiting for their turn.
3. The porting is subject to gaming and the people who know how to work the system will be the most benefitted by this.
4. It will also eleminate any potential for the spill of visa numbers from Eb2 to Eb3 category as Eb2 itself will be backlogged
It should be noted that the immigration benefits are associated with a job requirements and not a person's qualifications. Changing a GC category should not be allowed except in certain extraordinary circumstances and through appropriate changes in the law.
Mpadap, your arguments are valid but not pertinent to what I am trying to do. If a person becomes elligible , he/she must be allowed to apply for the positions matching his qualifications. Only thing is that he should not benefit from the portability of PD.

The requirement for a transit visa to enter the UK is not a new requirement. They were introduced because a significant number of passengers decided to remain in the UK rather than simply transit.
Before they were introduced, passengers had the ability to remain in the UK for up to 24 hours, enter the UK, change airports etc (this is called TWOV or Transit Without Visa and still remains for applicable nationals).
The intent of the Transit Visa is to ensure that the passenger will be accepted by the third country.
There are still issues with passengers who hold transit visas with a stated intention of transitting the UK. Either they are not accepted by the transitting airline and are returned to the point of origin, or they simply claim "political assylum" when they land in the UK and then they become the responsibility of the British Government.
the previous transit visa was a reuqirement for those that wanted to leave the airport...hence the 24 hr period. i have no issue with that- just to clarify. i do appreciate what you point out - that people overstay.
the new avatar of the TV applies even to those that are simply changing gates- ie walking from one plane to another WITHOUT ever setting foot on UK soil. i know this because i have changed planes in LON in the past WITHOUT a transit visa. in some cases as the air india passengers have pointed out, you don't even change planes, you are offloaded and go through security, and then return to the same plane again...hey tell me why i should be harassed and pay 90 bucks X 3 for my family- not to mention traveling 300 miles because "personal appearance"s needed- just to climb back on the plane and continue a journey? how can i seek asylum or overstay without being on UK soil (the intl transit area in any airport before immigration is an intl zone) ?
as for the airline not accepting the passenger onwards, that is something all airlines determine at the point of departure these days, the americans do a pre screen at the airport to ensure no such hassles.
the previous version of the TV was perfectly fine, the current one, for me, is undue harassment, even if i have an AP i should go 300 miles to the nearest consulate to get one for the privilege of changing gates? sorry bud...don't see why. there are easier ways to go home, and if the ticket costs a 100 bucks more- hey that's just the TV fees anyway right?

I have received an RFE on my H1-extension too. USCIS wanted sealed copy of my trnascript from my foreing university.
To answer the original poster. You can file your I-485 since your extension is pending and you do have a receipt fro USCIS.

I never heard of an RFE for H1b extension. Are u sure that the RFE is not related to your I-140 or I-485?

Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2.

The protest followed the abrupt reversal last week of a June announcement offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas - reserved for skilled workers in computing, engineering and other special professions.
Thousands of such visa holders scrambled and spent money on lawyers and medical exams to beat the July 1 deadline for green card applications. The abrupt change sent them back to the queue for 2008.
Besides India, skilled workers from China, Poland and many other countries will now have to spend more time and money to get the coveted green cards - a halfway house to US citizenship.
"The idea is to push them to honour their earlier notification," said Aman Kapoor, founder of Immigration Voice, a forum that inspired the unusual protest.
Indians are the worst hit by country quota caps for immigration visas, which treat a billion strong India, boasting a highly skilled workforce, on par with a country like Trinidad and Tobago of one million souls, he said.
On its part, the USCIS response was equally pacific. It plans to forward the flowers to Walter Reed Army Medical Centre and Bethesda Naval Hospital in Washington, the main facilities treating US soldiers wounded in Iraq and Afghanistan, said Gonzales in a statement on the agency website.

I understand your point. But this is exactly what anti-immigrants complain about H1Bs. ( depressing wages, outsourcing etc)
It is interesting that we are using anti-immigrant's arguments to pin L1s.
I would like to point out the differences between H1B and L1
1. There is a yearly limit for H1B (65k + 20K) but L1s are limitless.
2. A minimum wage need clause is there for H1B but minimum wage is not required to be paid for L1s. There are people in L1A visas who are supposed to be Senior Managers are sometimes paid less than 60K per annum by these offshore companies. As although they are brough in L1A visa they are in fact developers.
3. Almost 99% of the L1s are from offshore companies whose main intention is to send the project/job to offshore, most of the H1Bs do not have this intention.
4. L1s cannot change their employer, so they are bound to follow what their offshore employer ask them to do i.e try to take the job offshore, H1Bs can change employers, they will not try to send the job to offshore as they will then eventually have tomove back to offshore.
So if we clearify these points even to the antis, I hope they will understand who is the real culprint for the employment scarcity. Each of these companies are moving thousands of jobs out of this country making the problems for Citizens/Green Card holders/H1Bs.

We wasted lot of time, money and effort with this 485 filing for the last 15 days. I am terribly disappointed with the outcome now.

I got only one set of A# for both the applications. When I filed my second application I didn't have my A#. But we have mentioned clearly that there is another application that is filed on behalf of same applicant on MM/DD/YYYY.
I am seeing people getting multiple #A numbers and delays.

I think you may have confused them by stating that you possess a H-1B and a valid EAD. You need to get H-1B out of the picture. Assuming you have AOS pending, you don't need H-1B to be in status.
They way I read the email, it clearly states that if you are on H-1B you are not protected from citizenship status discrimination. However, you are not complaining about discrimination on your H-1B status. You are not asking for sponsorship. I think you need to forget that you have H-1B. That is completely IRRELEVANT. Once you use your EAD, your H-1B is automatically invalidated. You need to say that you have have EAD and AP (with pending AOS). Whether you have EAD/AP because you are EB immigrant, FB immigrant, asylee or refugee SHOULD NOT MATTER.
My suggestion is that you don't give up. Call them and explain them again by keeping the H-1B status out of picture. Somebody denied you employment based on the fact that you have EAD. You have EAD for work authorization and pending AOS as legal status. Thats all you need. Remember, that you can be in the same situation of pending AOS and EAD even if you are not on H-1B. Your current H-1B has nothing to do with this. If I were you, I would file the charges.
In addition, you may want to contact ACLU. They might be able to line up a lawyer for you. Although, I think they will probably just advise you to file a complaint to OSC.

My piece of advice -
I see that a lot of people are not happy about L1 visa holders replacing them or their collegues because the sponsering company is either not following the law or found a loophole.
It is natural to get angry and frustrated. But I would suggest - not to be insensitive to those people as it is not their fault. Treat them well and good and help them understand what it is and why are you concerned.
Do a proper assessemt on what exactly the issue is and definitely help ourselves to make sure fraud is not being committed.
