Guys,
Let me explain my situation .
I am currently working with Company A on H1B , applied 485 in August, e-filed EAD 2 weeks back . My project is over and i am on bench from past 3 weeks.
I have few full time oppurtunities to work with EAD
1) Can i change the employer without the physical EAD with A# and LIN # after RD 180 days passed ?
2) Can i give 1 month Notice to employer now and wait till i Get EAD and start once the card comes ?
3) Wait till the EAD card comes in Hand to do any thing ?
Appreciate your Help on this.

My employer looked at DOL website and found the status is in-process.
Another question : when you say back to normal process, what do you mean ?
I found that the "Govt error appeal cases" are processed as current, standard appeal have a backlog of aug 2007. My employer said mine wouldn't fall under any of these two conditions. He is confident that the CO just will certify anytime soon. Is this the case ?

Company "A" negotiating with a person who does not have paystubs, as he always been on bench.
during this time Company "B" apply for H-1B Transfer(without paystubs as they plan to submit later in a week or so)
Company "A" did the settlement and issues paystubs etc... but same time they apply cancellation of H1.
Can a transfer be done like this???
Please advise as i am dying day and night.............do not make a fun of it.

My relative tried to get visit visa from Kuwait. He was there on visit. Embasssy rejected the petition and told him to go India and get the visa. Eventually he got it in Madras. Only residents can appear for visa interview. (residents means, locals or, those have employment or dependant visa and stamped residence in passport).
If they are staying on a resident or employment visa in UAE they have to apply at the US Embassy in Dubai. If they are on a visit visa in UAE, they have to apply at the appropriate US Consulate in India.

Hi,
I am on L1 B (Individual) Visa since last three years. In January my company filed for extension, this time on L1 (Blanket). I received RFE in March, which my company replied in April. A couple days before the attorney called us mentioning the petition has been denied and I am awaiting final documentation.
Here are facts:
I am Senior Product Manager with Bachelor's in Computer Science and around 8 years of Experience working with the same Company. 5 years(India Subsidiary) and 3 Years US HQ.
We did mentioned in our RFE that I have the sole knowledge of two products that I represent and that with other things to convince USCIS.
My company is open and willing to appeal against the decision.
Questions: Could it be a reason that Attorney couldn't represent my case well and in that case should I reconsider other Attorney who is specialized in L1 process.
-Can appeal process buy me some time and should I start my H1B process simultaneously?
If yes, is that something which I can do legally.
-How much time can appeal process buy, is it two months, 4 months, 6 months ??
- My wife is on H1 and I do have 10 years B1 visa on my passport. Given those circumstances I do understant that my options for legally staying in US are open but I really want to avoid compromising options and save current working status.

Are you working for your new employer now? (I assume not).
Is you new employer a consultancy, i.e, your final work assignment will be for another client... if so, then you should expect a RFE (not gauranteed, but most likely) regarding client details and contracts... assuming you fall under this category, I would suggest you to apply for premium processing if you are able to respond to such an RFE...
But otherwise, I wouldn't recommend using premium processing, since you are almost 6 months away from expiry....

I just got my 3 year h1b extension today, was filed under premium processing. Everything the same except u pay $1000 extra. I got my approval in less than a week.

The only other thing I think should be stressed is that we are already H1-b holders, already applied for green cards, so not taking any more jobs away from USCs. All we are asking for is expedited processing of our already filed applications.

Hi,
I am on Adv-Parole (with EAD) and planning to visit India in July 2010.
I know that UK and France require transit visa, but I was wondering whether I can fly via KLM (Amsterdam) OR Lufthansa (Frankfurt) without any transit visa ?
Will appreciate the response.

I can say with certainity that transit visa is not required for return through Amsterdam on AP. This year 2010, was my second travel through Amsterdam with AP and the port officials really respected the document and treated me very well.
I am on Adv-Parole (with EAD) and planning to visit India in July 2010.

Thanks for the reply roseball. My question is the new I-94 number that I got with I-797 does not match with what was given at POE but it matches with my husband's old I-94 (which is because of the error when applying).

Yes you can but at some point it is safer for you to have worked for at least some time with Company A. Please confirm with others.
Between, you just invoke AC21 automatically under the guidelines - there is nothing to "file" per se, unless you want to send out your new offer letter to USCIS along with other supporting documents.

We applied on June 15th (TSC) still waiting...currect EAD exp. next week :(
I applied on Jun6th and got my EAD 2 weeks back. I took infopass to expedite the process. The IO wrote an email to someone in TSC. I got approved next week. Give a try taking Infopass.

I am a green card holder, becoming eligible for citizenship in April 2009. My fianc�e has been in the US for the past 2 plus years on F1. She completes her MS in December this year .We plan to visit our home country in August this year and get married. I thought this was a relatively uncomplicated case till I read in some forum recently that marriage to a permanent resident can be a barrier to being admitted to the U.S. in F-1 status. This is because such a marriage obliterates the "non-immigrant" intent required for F-1 entrants. This could very easily jeopardize her plan to re-enter in F-1 status.
Any thoughts or advice on this? Appreciate all the help.

IRS can also FAX the tax forms and W-2's but they do not have that information for the latest tax year. This means that they will not be able to provide you with the 2006 tax return. Also, my lawyer asked me for W2's of past 3 years. Both my husband (since he is on H1 too) and I had to provide W2's of 2004, 2005 and 2006
