Companies can and will have internal documentation standards regarding employibility.
In fact lately, judges have even upheld firings of smokers from certain companies.
IF there is a pattern of discrimination based on age, sex, national origin etc etc. THEN you can sue.. but NOT just because you don't like the policy of the employers..
People don't realize it but US laws actually give plenty of leeway to employers related to that.. only relevent law applying here would be "EEO" and that doesn't mention anything related to EAD.
Legally you don't have a leg to stand on.. but you can try.. tell the lawyer , they have chance to set precedent!

No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.

I didn't submit non-availabilty to attorney. Last time in Sep 2005, I was about to file I-485, they didn't ask. Not sure, if the Non-Availability thing came up after Oct 2005.
My father tried to get a Non Availability certificate but they told since the birth is registered they can't issue one and that they also won't change the name...:mad: (after the incident where that MP tried to sneak people into Canada they are very strict it seems)

Exactly you are right. Right now they are concentrating on EB2 only. Once the EB2 becomes Current all the visas are rollover to EB3.

You are wrong here. Do you know that companies like TCS/INFY/Wipro offer �blended rates� in the range of $20+/hr for keeping over 70% of staff offshore? Client directly benefits here. I have seen hypocritical companies that took tax benefits from local governments like cities and counties (which came at the expense of property taxes paid by residents of those localities) for job creation and then turned around and outsourced the very same jobs that they were supposed to create to TCS/Wipro/INFY etc., often dismissing the existing contractor pool/employees which involved people of all nationalities including H1-b workers like �TN Man� who couldn�t compete with the $30+ rates for the on-shore workers even if something was available from these vendors. Now to dump people at $30/hr rate, even though talent is locally available - like "TN Man", these vendors will abuse H1 and L1 by securing as many of these visas as they can( which were intended to bring the best and the brightest for american companies), causing Bill Gates to advocate for unlimited H1-bs when in reality, what he needs is a few thousand H1-bs which should be available in normal circumstances, had these companies not been poaching those visas.
So these offshore companies circumvented the prevailing wages through an industrial practice that should be considered �dumping�, where they dumped green-horns for the greedy clients, because the green-horns don�t have to go through any interviews in exchange of the very low rates. In this case, the people dismissed from the company/contractors were a lot more skilled, yet managers like me would be forced to start from scratch with the new pool, often resulting in delays for strategic initiatives at these companies, but the bean counters at the top never care, since their horizon is the next quarterly earning release, not what the company would do 2 years down the line (and some of these companies are the culprits behind financial crisis today with their very myopic thinking, just a sample was illustrated above)
The only jobs that were created in those localities due to such corporations in exchange for tax credits often were Indian Grocery shops opening in that locality to cater to those folks from offshore vendors. :D BTW, I don't have anything against them, I like Indian food.
I have worked with companies where I managed a 50+ member team to execute a project which at another company employing local workforce may have been done with a 12-15 person team (I have managed it both ways and hence I know that as a fact). Now the company employing the 50+ member team will often massage the numbers to show that they saved $x differential per person* 50 for the bean counters and would have secured bonuses for the higher ups because of those paper savings.
Now I think as a result of people like me interacting with US law-makers, they are getting the true picture of the abuse going on with the current processes. I understand many of you here are concerned about your own career and eventually settling in US, but once you become a permanent resident or US Citizen, you are going to face the same realities. I have seen Indian-americans who went through the GC/Citizenship process becoming some of the the fiercest critics of the current system, because (like "TN Man"), their livelihoods also are threatened by the current process. They suddenly understand that it has nothing to do with the so-called "skill" or "talent" shortage, it has everything to do with what your hourly billing rate is.

I have the following question
1.I have approved an I140 from Vermont. Where do I submit my I485 do I have to enclose I140
2. My spouse and children are in the US do I need to submit affidavit of support, W2 etc
3. There is an A3 in my Labour Certification but not in the I140, do I use this A# in the I485

A# is the alien number that is given to the applicant during the GC process. It is either given at 140 approval or at 485. If you have a A# in your 140 approval then you can use that # in all your 485 forms.
To answer pranju's question, yes its only for primary applicant. You can leave that field as blank for your spouse.

Thank you. I am not worried about the three companies I know of , I am worried about other 3000 companies that I don't know of.
I also beleive, it is not the companies that are evil. It is the system that provides the incentive. And I am trying to take away that incentive.
First: I appreciate that you have not lost your cool yet despite all the opposition and rude posts against you. We will not close the thread as long as the discussion remains civil.
While I personally do not support the lawsuit idea because it divides the community in two parts and there are better ways to help the community. You can try to help positively for the greater good for everyone or run a negative campaign that will help some but hurt others who are also like you and are genuinely following the law. I also think it will be expensive and may not have a lifeline. As IV members we need to all work together to fix the system. This was the basis of founding IV. The aim was never to look after our own selfish interests and hurt others who are like us. We never discriminated between different EB categories or country of changeability. The intent of our fight is not to deny others their greencards and get ours first, but to allow everyone get their greencards. The intent is to have the system be efficient and work the way it was intended. IV core team has never made action items or ask lists in campaigns to suit their own selfish needs.
Now in this post you have raised a serious issue. If a fraud is going on, do collect evidence and file a complaint against it. If consulting companies are making money by gaming the system, drag those companies in your complaint. Help punish such people who are gaming the system. IV community will appreciate that.
There is some wisdom needed here to draw a line between selfishness and working with honest intentions to clean up the system.

One idea is to give GC to AOS applicants regardless of namecheck result, if all
other security checks are OK and let the namecheck run in background . If the namecheck turns out critical , cancel the GC & deport the applicant.
But USCIS and lawyers will loose big time , because of reduced demand for APs,EADs etc.
This is exactly as Congress intended it to be. There is no mandatory requirement to complete NC before GC can be issued in the INA. There is a provision to cancel GC in the INA.

Folks,
Today at 2:03 PM EST I received the coveted CPO mail for my wife. I was approved on Sept 3rd and was the primary and I have not yet received the CPO as there is Biometrics issue, my wife had the same issue but the vagaries of USCIS which is worse than Indian monsoon...
I wish Caliguy, Fatjoe, Apb and many others who are at or older than my PD get their approval soon. If I can be of assistance in any way to you guys please let me know....My wife her case was separated from me and I was worried that it fell thru the cracks..but my persistence with all the channels especially congressional and POJ I guessed did it.
Not that you guys are leaving any stone unturned but just keep trying...
She was at initial review stage till Oct 2nd and not preadjudicated and separated from primary case and bingo on 5th she jumped to CPO...
You really never know...
Take care and I'll still be visiting IV and commenting and helping out..

My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.
So long as you make sure that USPS or the courier does not deliver it before July 2nd, I don't see any problem.

Ofcourse, they have to put up resources, van, driver to drive these flowers and deliver.

Thanks for the compliments, I'm happy but we will be thrilled if apart from compliments, if you've said that you have just written to change.gov or to atleast one or two reps. Just spend a $10 on postage stamps. Dont think the reps dont read our letters.
If you want a green from me, in your reply, please reply with atleast that you have posted this on change.gov, under Agenda--> Immigration--> Submit your ideas. OK? after really doing it.

I am so emotional now........just got the email, text message and message on the website changed to "Decision"
Mine, my wife's and my son's cases APPROVED!!!!
My case was in NSC. No additional fingerprinting, except one in Oct 2007, my son had to do one since he turned 14 this year....
14 years of wait is over......Praise be to God for his faithfulness and mercies

You are wrong. Even with valid H visa you need TV for UK. My wife had valid H4 visa in passport during her last visit to India and she had to return home from the airport and pay extra $ 250 and travel next day via Paris.
According to check in agent per UK rules even if you have a valid visa but have not travelled intyernationally within last 12 months you need TV.
So its not just for ppl who have AP or expired visa, thoise who have valid H visas but havent travelled out in last 12 months also need it.
For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
