I would say a very transparent administration and solid institutions along with excellent educational systems is a key reason for these small countries being so competitive. Much of Asia and Africa is bogged down due to unstable political condition, rampant corruption, weak institutions and regulated economies, not to say low literacy and paucity of skilled workers.
In finland, denmark, iceland and other small northern european/scandinavian countries, English is the main language used, making it much easier for new immigrants.these small countries have to use english to stay competitive and communicate, because most of the world including europe do not speak finnish or swedish.

Do you know any example of I-485 got rejected after using AC21?
My lawyer says they haven't seen any case like this before. I want to make sure before I change jobs.

If people who got their AP from NSC could just menion how long it took for them to receive ap document it would be statistical and we can there upon make some judgements !!
Noone is asking for exact dates from USCIS. We are all still very much in a limbo and this is just for getting some heads up!!

I, personally, do not know anyone who lives in Canada and is complaning about jobs. Every beginning is difficult but for us who come to Canada from the US, I do not think the beginning would be difficult at all. Even with their famous Canadian exp only requirements....
Also, when you guys weigh in job prospects in Canada in comparison to being on H1 in the US, do you consider that your spouses would have a fair chance to at least re-start their careers or start their new careers, or do you think / know that your spouses will actually continue to stay at home?
In that case there is no difference between staying here or going there, right?

Hello,
I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

Even I got an FP notice 3 weeks after getting the welcome notice. Then they also updated the status to Card Production Ordered and Post Decision Activity. Finally got the card after more than a month. I still have to go for FP later this month. I don't know what the hell is going on but at least I got the card.
I am still waiting for my card, but I received a FP notice yesterday. I think I'll get my card once I am done with my FP.

Please consult with an immigration attorney, to make sure your stay is legal. if your i-94 expired, unless you get the revised I-94 with the valid dates, your stay is illegal. If it is more than 180 days, then you are in deep trouble. Consult with an attorney and prepare to leave.....

I received an RFE too in Nov 1st week. It was about the evaluation. (It was submitted earlier but still) Lawyer mailed them the required document and now the status has changed to "We received your response to the request on Nov 14th and the case processing has resumed".
How many days does it take them now to make a decision? (Btw I am EB3 and my 140 submission date was Nov 2006)

Thank u so much for the info you've collected. In my case, PP expiry is sometime in August. So no issues with that. And I assume the I-94 date issue is applicable only if I used the AP instead of AVR while coming back.
And yes, as per Murthy's site, I'd be carrying the telegram with me to show the IO if needed. And yes...you are right. Its only good NOT to lie to the IO at the POE and promptly tell him that I had been to Canada for landing purpose. There were some callers who were criticizing foreign high skilled immigrants and that jobs were being taken away from them and wages were being lowered and they are being allowed to come and stay in the country.
Lets see how the hearings go in Dallas. FYI IV has tried contacting the speakers in the hearing.

Every person must take the decision after consultation with a good attorney in AC21 matters and after looking at their own GC, Job, career and personal life situations. There are some areas like salary and same or similar job criteria that must be carefully looked at. There is no general answer to the question above. Each person must do what is best for them. It is speculated that a lot of people will invoke AC21 from next month after crossing 180 days and seeing that the upcoming visa bulletins will only push the dates back for countries like India and China. This would certainly frustrate a lot of people who do not see any career growth and may have to decide if they wish to be stuck in the same job for several more years or change jobs.

How did you enter US? if you entered showing H4 visa, that would be an unlawful entry. H4 cannot be valid after h1 was approved as a change of status. Your status changed from H4 to H1, so you couldn't enter US through H4 anymore.

Murthy's lawyer suggested Consular processing as an option.
She explained that in Consular processing I still need continued Sponsorship from my firm, but it will revoke my 485 application. I will end up filling bunch of forms with USCI, including 824.
This was my PD will remain intact and when it becomes current, I will have to go to Indian Consulate and get Immigrant Visa from there.
IN this whole process My firm needs to continue sponsor my GC processing. Advantage is : I don't have to come and renew my EAD and AP every year.
If you really want to maintain your PD, you can go for CP while studying. After school finishes, if need be, you can always come back on H1 again before your GC is complete. This way you will have both options Europe and USA !!

sanjay , prinive - believe me folks, a lot of pushing is needed, not everyone are proactive like you and me. I guess you are in the tri state chapter - you can see for yourself, how many members are active and how many are not. I am also just like you all - the core trusts me to be a chapter lead and I do want to do what best I can - I will be very happy if more and more people come forward and carry things forward.
