I think most of EB3I and EB2I are missing one point.
EB3I didn't loose anything by the change in spillover policy few years back.
It is EB3-world who lost. Obviously EB2I and EB2C was on the gainers side.

Sorry i updated under the wrong thread.
ours was a paper filed on July 2nd. Card was mailed on 08/07/08. Still waiting for it to make it to the mail box.
I have not recieved any FP notice yet. Surprising I also saw a soft LUD on AP when care production got ordered for EAD but no updates on AP or FP yet.

Also, if you google there was precedent with some guy from India. Who had similar agreement and left the company. The company sued him and lost, appealed and lost. The guy sued back and won, the company paid $200,000+ something expenses. The case was long ago, I don't remember the link.

While it seems like a great initiative - lets take a step back and examine the "materiality" of the $5MM number........
1. Annual budget of a typical State Univ is upwards of $1Bn.
2. $5MM can pay for college education of say, 100 kids (only about 50 if you include living expenses)
So, what the message that would go out in media would actually read like is the following:
"100,000 green card applicants trying to buy their way to US Residency by sponsoring 100 kids' college education and/or contributing 0.2% of Ohio State University's Annual Budget"
To the average American worker who has lost his/her job or knows someone close who has - this would, in my mind, seem like a bribe........and make them anti-EB if they already were not.........
All immigrant and non-immigrant workers do their fair share for this country by paying their taxes and abiding by the laws of the land + they pay significant fees during their entire H1 and GC process- a proposal that involves them shelling out any more $$s would only create a sense that we are trying to buy our way in plus its not really fair on the applicants in any way.
Well, you are missing the most important point - Illegal immigrant's probably don't care about the future of the country's educational direction. Family based immigrants don't care either. However WE are EB immigrants and we value education and that is exactly what we demonstrate by doing this. We should not be looking to fund hundreds of thousands of student's college education - heck even the mighty US government cannot do that. We are not a political organization. The way this will go out in the media is - these guys could have used the money to lobby with senators or other congressmen, instead, they choose to use it for a good cause. This is highly symbolic. And the key here is to involve the first lady. The moment you involve the first lady, it become apolitical.
Oh, and btw, we are not buying our way into a GC. Nowhere did I mention that. We, EB immigrants value education and hence want to donate for an educational charity/cause. We don't expect a GC by doing this - this is highly symbolic; however if the Obama administration takes up CIR this year and we start this campaign and this happens to go to the first lady and gain media attention at the right time, perhaps the administration would include legal immigration in the CIR which would have otherwise not been included.
Timing is critical to this. If we gain media attention a few weeks before CIR comes up for debate, we might have Legal, EB Immigration included into it. And CIR this year is our only chance and hope and if EB immigration is not considered parts of CIR, then we might as well kiss our GCs good bye.

I agree 100%, all these consulates are peace of crap, the way they behave is un believable, I have been to New York Office twice, both the times very bad, I don't think they change...

Believe it or not, I was about to open a thread like this. And here is the worst part, my AP has been approved 10 days ago, and so far neither the online status changed to approved nor i have received the approval copy. 2 ways I found out my AP was approved was through my local congressman and I took an infopass appointment. In the info pass appointment when I asked what is causing the delay in sending an approved AP, the officer says, if you did not get the approval notice in 45 days, call us back. This after waiting for more than 90days from the date of application. So, its not there until you have it in hand. Merely getting an approval these days is not enough, since they take anywhere upto 45 days to send the approval to you.

My wife's EAD card was delayed beyond 90 days. I called USCIS 3 times and they did the service request, but told us we would have to wait 45 more days. At the 96 day mark, I quickly filled out requests for my senators office to get involved and they helped out. EAD was in mail the next week.

Reading the bulletin thread and prediction thread is good enough to prepare for GMAT problem solving area. I love these analysis and conclusions.
I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.
The other possibility always exists that the numbers were released for this quarter but the demand was SO HIGH that the net date did not move at all.

It is not true that Many people have to wait 10+ years to get gc. May be some people might wait for 10 years because of frequent change of jobs , layoffs and also ignorance of green card processing. Most of the time EB2 waiting time is 2 to 3 years. Indian EB3 is in worst situation but only for past 2 years and before that everything was current. For that also most waiting persons filed I 485 because of July VB issue. In my opinion EB3 PD will be backdated up to 5 years.
Also there is no legistrative activity in Congress about any immigration issue. Always skil bill comes in limelight when congress is in Session. But everyone knows that skil bill is asking too much in H1b and immigration numbers because of exemptions and it will be very difficult task. But no one in pro immigrant community is ready to compromise on numbers. When Congress tries to curb the abuse of H1b even pro immigrants are opposing the bills without any suggestion of any alternatives. If some bill comes for only GC that too moderate increase in numbers that will have bright chance of passing in congress.
You should not expect any rally will produce meaningful reform. It has to be proved that additional immigrant and H1b numbers will produce more jobs and it should not create unemployment in americans.Just sufferings of gc waiters is not enough. My opinion is Rally will be used to show strength of IV and may educate public and Congress. But anti immigrants also doing Similar Campaign(not big rallies) by negative points of immigration. I got my I-140 Approved in 2007 and I-485 applied in July Fiasco. working for same employer who filed labor in PERM. Recently got letter from DHS stating that I485 denied as it was filed when dates are not current.
In july 2007, USCISreleased memo stating that they will accept all applications till August 17' 2007. Mine was reached on Aug 14'2007 well before deadline. Got I485 reciept in october 2007.
There are 2 dates on receipt. 1. Received Date (Aug 14) 2. Receipt Date (Oct 12 ' 2007).
They sent Denial letter to Attorney stating that I485 application was filed when dates are not current

Filed MTR thru Attorney.. Filing Fee is not enclosed as it is USCIS service error.
