You already applied with approved LCA. Any amendment to LCA AFTER the RFE may not be looked upon kindly.. check that with lawyer..
What he means to say is, if you are saying your next 3 yrs project is in CA, then your LCA work location should not be in NC.
If your LCA work location is in NC then they have asked for NC based contract.. I would provide that, and not one in CA. your case needs more detailed look before you dump everything in USCIS lap..

Last jan one of my friends who runs his own firm , applied for 6 H1bs of these 5 got RFEs similar to these.. he replied to each one with 300+ page reply , they approved all within 4 days.. so it's impossible for anyone to read thro' they basically do it for 2 reasons..

My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know
1. How many days is required to get a H1b transfer receipt.
2. What happens if my H1B expires before i get a receipt.

Tear up your passports which any way does not have any pages left with all the yearly renewals and flush them down the toilet. Join the line for Z visas. Believe me that would give you more options, no problems while traveling, no tie up with your employer, no H1B's, no LC, No 140, no 485, no AC21, no advance parole paper work. You will be a free bird in this great nation. I thought that it was only in African and Asian countries that you beak the law and get away with it but here the lawmakers are encouraging the LEGAL's tax paying law abiding to do that. And most of the time these individuals are best and brightest in their fields.

I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

No, you are safe in this case. There is the little gray area of you leaving the petitioning employer early, but since they did not revoke teh I-140, you can say that (if it came up in the interview) you intended to go back to them and they had all intentions of hiring you again. As long as I-140 is revoked past 180 days there are no issues. File for AC-21 sometime past the 180 days mark.

Good review of previous performance.
What could be different this year compared to previous years are
1) DOS seems to make sure no visas are wasted and so may not want to wait for the last 2 months of the fiscal year.
2) More cases are pre-adjudicated which makes it easier for them to initiate the fall-across/fall-down in July than wait for August.
3) DOS has been good at not retrogressing the the visa dates further back in the last few months. They either stay where they are or move forward. But not back. This indicates that they are paying more attention and not randomly opening up visas. This means they want to issue visas by priority dates which would need proper planning (to make sure nothing gets wasted)
All these above factors may influence them to open up in July than August. Again, these are my gut feel.

The greatest good will not be achieved by just passing the labor cert. stage. The greatest good is achieved once we have the GC card. Your effort on retrogression to benefit 250k & 200k is plausible. But you help them to pass one bridge, to just get stuck on the next. If there are 25k people stuck in name check at this time, imagine what will happen when the estimated 200k-250k reach that stage.
If the 25k spent in average 3 years in the name check, what will be the wait time for that massive population that are headed that way after retrog & labor cert? The EB process is a big picture and the greatest number will not get the greatest good until all these obstacle are resolved all the way to the end.

Myself & my husband received the EAD (with Nor FingerPrint Available), AP before the fingerPrint. On Sept 17th we did our fingerprinting. No LUD change yet. Is it the LUD needs to be changed after the finger printing? If not is there an issue?
