It is good idea. I discussed this my lawyer and according to him, nowadays USCIS is very strict about it and trying to match the requirements of EB2 against the candidate's credentials. If it perfectly matches only they will approve. It will be an option for those guys with EB3 with PD past 2005 and with enough EB2 credentials, primarily a masters degree and if it from US, then great.
Please do not go into this option just by stating that I have 100 years experience with such and such company. I will say, if your are a masters degree holder (from US the best) and is employed with a major employer for more than 3-5 years, then only attempt this. Do not try it if you are employed with some Desi company. This is harm both the candidate and the employer.

You didn't say any where in your message that TSC applicants are getting RN very late. Sorry to say but it seems you are very mean and selfish person. But looking at only NSC your concern is currect.

I am just starting the Canadian PR process. Can you tell me how long it is taking right now? Also, do you know if you have to work for the employer if you are a provincial nominee?

Yes, a new passport ( from one of the US embassies in India). I don't think it is a new PIO card, but the new passport number will be 'annotated' in the Passport ( Indian embassies in US charge $20 for that ).

It could take anywhere from a few days to a couple of weeks. For me - it was around 2.5 weeks from the time the status changed to "we received your response....". Plus with the Thanksgiving break - it might take a bit longer. The best thing to do here is just not to worry about it and just wait...since its no longer in your hands.

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.
Kindly refer me to appropriate material if you know of any.

Surprised to see that you were unware of this. Getting GC is painful process as we all know. There are three situations
1) Don't file I-485 till you get married. Risk, you might have already used 6 years on H1.
2) File your I-485 and get quickly married , then you can add your spouse. Do a court marriage in US and later you can do a marriage ceremony in India.
3) File your I-485 and get green card with out having chance to add your spouse
Since you fall in category 3, your situation may be worst.
Couple of options
1) If the girl(or guy :)) is in US, absolutely no problem. Only thing is if girl is already in US, you will get lot of family pressure from girl side.Have to compromise on lots of things. May be will become a house husband.
2) Girl from India, now you have to find a really smart girl who can get admission to universities or pass TOFEL GRE etc with flying colors. Then long distance affair starts. Girl in city X studying guy in city Y. Meeting once in a month. Lossing lot of money on commute and mental peace.The girl will have now her own friend circle and over period of time she might start liking someone else. Based on real situations.
3) Move to Canada and apply for Canadian citizenship. That's easier to get and easier to bring spouse there. But again you won't be able to bring her to US
4) Wait for 5 years. Who will want to wait for you 5 years.
Best Option
Return to your home country and enjoy life there. Believe me you won't have never any regret in life. It's just not worth for all the pains and miseries it bring in one's life. GC : Grievance Card.
Good luck with whatever you decide.

per my lawyer you can come back from EAD to H1 by filing a new H1 petition (if its past 6 years on H1, then you need some basis like approved I-140 or old LC). You will need to leave the US and return to activate the H1. So thats always an option if you jump to EAD.
In your case, you can still file a H1 transfer, if it comes without an I-94 attached (meaning H1 got transferred, but status was not activated which typically happens when last H1 status ended more than a couple of weeks ago like in your case) all you need to do is leave the US and return some PoE where you will get hte new I-94
You cannot come back on H1 once you cross 6 years and you have switched to EAD. For you to get H1 extensions beyond 6 years based on pending GC , you should already be in H status. If you are not in H status (e.g. EAD or some other status) then you cannot get H without being outside for 1 year and being counted in quota again.

Does it mean that these developments or should we call no developments on the high skilled immigration front in the developed countries have an underlying message for all of us? Return back to your home countries.... In USA, one positive thing was that it has been 'the melting pot' of people of all cultures and nationality to come together. I will give you an example: my friends 2 year old says that he is an American and not his native origin. In UK, you will still find 3rd generation people telling their nationality to be of their native oigin.
In USA, the immigrants intergrated with the society but in Europe, the message is clear, you are here that is ok, but live in the other side of the city and have limited opportunities. If Sensenbrenner and co have their way, US would be on the same path.

20 amendments is a lot of amendments. If 20 amendments bring 20 additional votes, but if 6 votes are lost due to these amendments, then I guess the cloture will still fail.
Last time the cloture motion got 45. They need 15. In getting 20 amendments, if they gain 20 -25 senators, they will also lose some. So its still not a done deal. And who knows if one of those 20 amendments is like the Byron Dorgan's bill killer amendment. That amendment to sunset the guestworkers program in 5 years is the biggest bill killer that got approved on wednesday by a vote of 49-48.

We got our EAD in the mail today - We are late June filers (29th June) and got our receipt numbers last week, - I have some q's-
-Can one get EAD without completing FInger printing? In the finger priniting colum on the EAD it says - not available, Would that matter?
-How does one activate his/her EAD?
-Have any other late june filers already got their EAD?

It is not justified, if people don't know what USCIS is referring into. All big lawyers have its subscription. So they guide their clients in a proper way. OP's lawyer screwed him to file in EB2. Even EB3 also difficult, if the advt. is for a US equivalent degree requirement. May be put advt. for a associate degree or non-degree positions with some college studies. For EB3 candidates did not require a degree, if the position advt. says so. But prepare for a tons of applications for that position.

1) file H1 on Apr 1st and if H4 is not approved by then withdraw pending H4
2) file H1 on Apr 1st before the current H4 expires and hope that H4 is approved before H1. H1 should be approved after H4 to have the H1 status. If H4 is approved later, H1 status will be lost
3) Request PP of extension and 99.9% of time 539 is approved along with 129.
I will add more info as I find.

My current H1 is going to expire on june 07 along with my wife's H4. I applied today for my extension along with the H4 in premium processing. Shall i go ahead with the new H1 for my wife on April 1 in regular processing even without waiting for the extension or wait for the approval?
