I saw a comment on a lawyer's website that recapture of unused visas can only be done through legislation and not through administrative fix..
And, the real issue we should try to address here is USCIS inefficiency.
There are a lot of " worldwide" category folks who have been current for over a year (and a few months after the 180 day memo) but are yet to get their GC.... So unless we get USCIS to move fast on the applications that are current, all our visa recapture efforts help DOS to move cut off dates further ahead.. but if past history is any indication, more of these visa #s will be assigned to Consular processing cases rather than AOS cases in USA..
So.. I think while lobbying for Visa Recapture is the right move, we should also lobby to highlight USCIS inefficiency in adjudicating cases that are current..

Hahaha, despite the fact that an ever so considerate d100 user decided to sit himself at the edge of the runway to check his images on my last show shoot, effectively ruining 30% of my shots. I have no grudge against nikon except for the fact that it wouldnt have killed em to put some curves on that D70.

Same here switched jobs in April with approved 140 in EB3 and hoping to get in the EB2 line with earlier priority date and now have nothing with EB2 PERM in audit. Hope to keep the priority date atleast.....

Consult with the attorney on alternate evidence. I believe USCIS in most cases does accept alternate forms of evidence. Not every company issues experience letter, so in this case alternate evidence should suffice provided you have enough of it. As mentioned above, I wouldn't bring up the bond issue. That'll potentially open up can of worms unnecessarily. A company is not obligated by law to issue experience letter.

H1 extension was applied in CSC. Yes my attorney should be able to help with a letter. But I'm weighing in options as to what can be done to avoid my H1 extension as I can use EAD.

Are you out of your mind ? You are taking a huge risk by staying in the US and droping your Canadian PR because of some "probable" green card. What makes you think that by the time you finish school the situation will still be better in US. I hope you will not regret this but think about your family. In 3 years you and your family could be happily in BC with free health care, great weather, less stress, travel wherever and whenever you want, have your own law firm.
OR you could be a stressed H1B (a.k.a educated slave) waiting for I-140, I-485, EAD or whatever to come through.
Just because you asked, I have been in this same situation. But in my case, the decision was easy. I was on h1b making 69k. The same job in Toronto offer $55k CAD. Much less, but with my freedom to consult on the side and my wife's income we bring over $100k. We vacation in Florida for a month every year to visit friends. Life has never been better.
Whoever tells you to stay and take the risk is putting your family's hapiness in jeopardy. But the choice is yours. Just don't come here crying when CIS finds a problem with your application.

However, some stuff I've been seeing on sites like notcanada.com concerns me. Is Canada really a place where it's more profitable to sit around and collect welfare than to work, assuming you can even find a job? Are Canadians more racist than Americans? Is it really hard to get by career wise and socially if you're not a native or have the appropriate connections?

--I wouldn't do such a stupid thing. You withdraw I-140, your I485 goes to fish!

--Your "lawyers" are narrowly focused on being able to apply for another I-140 by withdrawing the pending one. That is not right. Especially, given the the situation that your I-485 is pending, I wouldn't mess with pending I-140. You may not get a chance to apply for another 485 in a reasonably foreseeable future!!
Ask your lawyer to find out if he can apply another I-140 while one is already pending. I believe one can do that if the job description is different. Not sure.
If he cannot, then let the LC that you currently have expire. You can start another immediately. It will take some time for the whole PERM process to be completed. You would have gained sometime by then and your pending I140 may be approved by then. If not, you can jump to the new process.

OK, for those who thought my name suggestion was serious , well I was just kidding, cuz this topic itself was a joke so I just played along with it,
I am not really effected by GC delay, cuz I was able to file I-485 in 2004 and I changed my job twice using AC-21 (refer to AC-21 thread I explained my situation), Also my wife is working with EAD, so I have no reason to go insane, but remember I still contribute to IV and itz cause, while I know many guys stuck in labor for last 5-6 years are still skepctical about IV.
Now back to H1B subject, I am glad IV is not promoting H1B increase, just because I came in H1B it does not mean H1B any better,

a recapture helps everone by moving the line forward and making dates current. there is also a parallel effort on to bring changes like 485 filing without PD being current. so no one ie being left behind or ignored. these efforts will help all of us affected by retrogression and stuck in different stages.
If IV can help this (apply for I-485 without having current PD) proceed in anyway, I would be so happy. I got married 2 years ago, my wife is a finance professional, an employer in US applied a H1b for her, ended up getting rejected in the lottery.
I had just (during the open I485 time frame) then switched employers and my employer filed for labor which never got cleared in time (actually still isnt cleared - random Audit).
So my wife and me are shuttling between India and US to even meet each other.
Have been in US for 9 (with 2 masters and 5 years working) years now, still no way of finding a visa for my wife to work.
I work for one of the big Biotech guys and kind of like my job, otherwise working in India along with the wife looks very intriguing

For the record, filed I-140 and I-485 concurrently (EB2) on June 21 at NSC. Got FP, my wife got EAD.
My lawyer tells me so. Also, the bulletin you cite is very old. Most people stuck in name check, for which BTW there is a separate thread, will coroborrate what i've said.
