    Hi All ,

    Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Also not wasting further time i would like some info which is purely based on my discretion , but suggestion is well appreciated from u end .I would like to know wat r the things to be followed in h1 . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . Im all confused as to what is my status coz at time im told that im on student visa and at time on h1 . Also if i find a job i will be paid only wen its valid . currently i stand on a crossroad of confusion , agony , pain and frustation . pls some 1 guide me thrgh this and if reqd i would apprecciate if u can also mail me . Trust me this info will be only confidential . i have loads of queries and from the time ie if my so called h1 is approved then i have still not got a job and my employer is done nothing much to market it . wat time frame do i require to be on job . pleaseeeeeeeeee help .email me at niharika.das13@gmail.com

    This topic is useless...!!!!

    What are you going to achive by knowing about US citizens..???
    If they make a rule wherin US born child parents should be given the US citizen ship, hands down I can say immigrant will make use of this rule efficiently.:D:D:D:D:D

    right. Either way one has to go through Labor pains. Atleast in this case the case is processed within 9 months, we dont have to keep waiting and looking for Visa Bulletins.

    Also, I am sure in this case no one is going to try LC-substitution.

    In addition, no one is going to agree to file a case as a 'future employer'. It will only be filed once the employee really commits to the sponsor.

    Guys please send the flowers...I know we dont have very good publicity like others...we need to find the way to get the media atten. One reporter might be intrested in our news not evry one, to get evey body atten we need to do it in samrt and in different way..guys bunch of people are thinking the flower day is good, other think it is not, we have this problem from ages.

    If one send flowers or e-mail it is not news..if every body joins it is gonna be a greate news.

    jokes apart - seriously this is a very exciting time, no one knows what will happen - yet everyone optimistic... which is a good sign.

    I just talked to our company lawyer and she said that they are seeing a lot of 485 approvals from the receipt dates from last week of july and a little before that ...

    When you said 'receipt-dates', were those the actual receipt dates or the erroneous notice dates that would appear in the online status page?

    I do not think this is standard. I worked for a consultant company for 7 years and never saw an agreement like that!!

    Yes !!!Also to me, it feels very fishy. The topic of this document is very misleading too..."Time Sheet Agreement" and they have included all the 'bonded labor' clauses in it...Thats why I have posted it here in this forum to get some feedback from experienced people who might have come across these nonsense.

    Hi Guys please help me

    Yesterday i got my receipt i check the status online the status is saying

    Receipt Number: LINXXXXXXXX
    Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
    Current Status: Fingerprint fee rejected and notice mailed; case in suspense.
    On August 21, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense.
    Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.


    But USCIS cashed my checks i didn't know what went worng the total amount i paid is 325+70,170,180.

    Did any guys get same kind of problem?

    You paid the right amount.
    $745 (485+FP+AP+EAD)

    All of of this, writing to the president, congressman/congresswoman are fine, but PLEASE, PLEASE make sure, that the following are adhered to:

    (1) Address the President as "Honorable Mr. President", and not "Hello Mr. Obama"

    (2) Please please please apply spell check and make sure that your letter/email/fax is grammatically correct. All of us claim to be "best and brightest" and "highly educated", but having seen the composition skills and grammar usage of a lot of us here, on IV, I would higly recommend having another person, who is more competent in the PROPER use of English language, take a look at whatever you write.

    (3) It would make sense to send letters (several thousands of them, if possible), to the President, on the same day. Even if a handful of these letters make it to his desk, each with same/similar content, but from different people, he just might notice it enough.

    You are right. I accept. I sent an apology, water under the bridge, Thanks for the reconfirmation. Now What can we do to make this happen. What suggestions do you have other than send more letters?

    Very good point. It's not worth the hassle to take a chance unless it's absolutely necessary.

    come on..once the rule is written it is written..so don't worry much neither press too much panic button. the receipt date is marked on I-485 and it is easy to prove it..so don't worry much..

    Even with 40 credits it is not possible for Indian nationals to get SS payments in India. If you look at the rules closely on the SSA website, there is no simple way to get benefits paid in India unless you are a US Citizen. You must be present in the US for that

    This database gives me an idea: Can someone who is good at programming extract all the data and build reports on how many labor certifications are there by category and by chargeability? IV tracker can also use this information to a certain extent. Unfortunately I am not a programmer so I cannot do it but I am sure for experienced programmer this should be a piece of cake.

    What do ya guys say? Any takers? Also we should know how to interpret the data. I have asked additional questions in my previous post. Answer to those will help us a lot.

    Congressman Udall spoke at length how the conference committee is formed, how it operates and how decisions are reached.

    One thing he said is particularly noteworthy. He said, he reads his fellow congressmen and the mood of the House, and at this moment there are 300 congressmen (out of a total of 525) willing to vote in favor of the senate version of the comprehensive immigration bill as it is.

    As I said in my posts elsewhere in IV, let's keep our eyes and ears open for the opnions of representatives and follow up on that.

    300 out of 435 Reps is a huge and victorious number! Or, did you include the 100 Senators in the broad definition of Congressmen? Even, then 300-67 = 233 is a successful number in the House!

    20 amendments is a lot of amendments. If 20 amendments bring 20 additional votes, but if 6 votes are lost due to these amendments, then I guess the cloture will still fail.

    Last time the cloture motion got 45. They need 15. In getting 20 amendments, if they gain 20 -25 senators, they will also lose some. So its still not a done deal. And who knows if one of those 20 amendments is like the Byron Dorgan's bill killer amendment. That amendment to sunset the guestworkers program in 5 years is the biggest bill killer that got approved on wednesday by a vote of 49-48.

    Same here...We received same FP fees rejected notice but checks are cashed. Our lawyer mailed the proof of cashed checks for 325 + 70. But to our surprise even before that we received appointment for FP.

    I think this is common error on USCIS system. Most probably they will send you FP appointment notice. So relax..

    I talked to my lawyer and they said the checks has been encashed. I talked to an IO, and he said that they did receive the $70. But I asked them why the status saying FP fee rejected. TO that he replied I dont see that. But since we have mailed you a notice, you go acheck the contect of the notice after you receive it.
    But my lawyer send an info from AILA, which says that the USCIS is erroneously rejecting the cases inspite of sending the correct fees.
    I dont know what to do ?

    I got my EAD card for 2 years on 7/16.

    It was paper filing on 6/22 at Texas Service center.

    I hope everybody gets EAD card in time and continue working.

    So, is that a yes on getting USCIS to follow the law? As I said, it is about getting USCIS to follow the law, it is not EB2/EB3 centric. Given that the demand for Eb3/EB2 that is going to see-saw, this should be an action item that will benefit EB on a whole, not a particular sub category.


    It is not only about USCIS to follow law my friend, it is about bringing about a new law to relieve us from huge backlog.

    That I believe can be only possible with the recapture visa bill. And we all need to shoulder each other through this.

    This seems to indicate someone else will get benefit payments but not the worker himself / herself.

    I am not sure. There are two red flags I see in this argument. The first is that for your wish to come true next 4 years you need only 30K GC labor to be filed. But analyst are predicting recession to be over by this year end or 2nd qtr of 2010 after which hiring will start and also the whole GC process. The second argument is in 2009 we were in recession with 30K apps filed but we did not see any huge jump in EB2 numbers if this bulletin had put dates in 2006 range then we could have said that the spill was really large. Looks like the spill was not huge since every one knew that EB2I was always somehwere near 2004. all they did was put it all the way to cover entire 2004.

    Due to the economic downturn there aren't many companies sponsoring GCs for employees. I doubt it would be more than 20 to 30k per year from now. This leaves 100-110k visas available every year for retrogressed countries like india and china

    if there 300-400k pending GC applications in all categories then shouldn't all of us get our GC in next 3-4 years?
