Thanks...but i agree with your paralegal friend.......there is no logic to it all.
logic and law are not usually on "friendly" terms....
i guess the argument is that one who hasn't filed, cannot be counted.... and you cannot file until you are current.... so no backlog exists .... so non-filers (due to PD) do not exist and hence there is no "official" classification for them i guess.

Folks,
Got a question on surrendering I-94 when leaving USA. Do we just need to surrender the one issued in POE when coming to USA, or we need to surrender the I-94 that came with I-797 approval notice as well. I'm getting different opinion from different folks, Some say surrender only the White one issued in POE, few say surrender the one attached to I-797 approval notice as well. One friend of my mine, was asked to show the part attached to I-797 when he went for visa stamping and luckily he surrendered only the white one issued in POE and he did not surrender the one attached to I-797, so he had it with him.
Folks, please share your experience on this.

My friends mom had a issues, She was here 6 months and came back after 6 months . POE officer took her for inspection and called my friend and asked lot of question , gave the warning saying 'Visiting visa is for just visting not to stay in US'....

My wife had returned from India on Dec 2nd 2004 and her H4 stamp was valid till Jan 26th 2005 - Less than 2 months validity. She did not face any problem reentering. Infact we filed our extentions after she came back.

My friend got EAD.His wife is on F1 visa.If he starts using EAD instead of applying for H1 extension, Can he able to join his wife to his GC process who is currently on F1 when his priority date become current.His priority date is Sept06.140 Approved.july 2, 2007 filer.485 is pending.

If the answer to all of the above is YES, then I was in the same boat and this is what I did
1. Visited the local Infopass office and requested the finger printing review date and name check approval dates.
2. Initiated an inquiry to find the cause for the delay. They take 45-60days to send a reply
3. Contribute to IV and complete the action items requested by the core. This is the only organization who is lobbying for the legal immigrants.

My wife went for H4 interview on 1/11 and she was asked 3-4 basic questions and her passport and original I-539 was taken. There was no other communication give to her and/or any colored slip given to her.
She has AP and 485 filed but AP didn't come through and she has receipt for both, but VO at delhi didn't look at them.
Its been over 6 business days and no information of passport yet.
We called up consulate and they say its still in processing.
I have read in prior forums with "PIMS", is this delay because of it?

As far as I know employer sponsorship is not required for EB-1 EA case; not sure why you had to file I-140 for this ...........
EB-1 EA does not need labor certification, but still needs I-140.

Going after employers to tackle the undocumented employees seems a better way of dealing with this issue of immigration than going after illegal immigrants. They are coming here only because they can find jobs.........and some of the employers exploit them too.

All i know is that as of yesterday there were only 18000 applications for Masters quota.
Why did not they get filled as fast as the Regular quota?
This is the reasoning my lawyer gave....
"Most of the applicants for Master's quota were in confusion after April 3 after reading several bulletins about 200,000 or so H1-B applications. And some people didn't even apply thinking that the USCIS may have received more than enough master's quota applications even though the bulletin said that they were accepting more applications for Master's quota."
I know of people who have submitted fresh H1-B applications under master's quota as late as April 7th.
So guys, wait for the official numbers. Don't believe me. But do compare when the official news is released.
I am surprised by the slow pace of Master's applications.

I am worried about my employer. Given the fact about I-485 apps and the last few days of labor in the previous month I have doubts about my employer. He is a very mean and hopeless desi employer and I am worried if he sold out my labor to some high bidder. is there any way i can find out if my labor is still infact in my name. any thoughts

GREEEEEAAAT NEWS. THESE ABUSERS NEEED TO BE BROUGHT INTO LIGHT. However, I feel they should increase the cap based on marked requirement. If one qualified person is recruited properly (following required advt), has the proper qualifications, and is proposed to be paid adequately----MY friends in senate and wherever--WHY SHOULD THERE BE A CAP RESTRICTING SUCH A WORKER???? Take away the cap completely and scruitinize the applications / employers more stringently. This stupid cap gives the USCIS / govt a false sence of security that everybody coming through is qualified and good. Once the cap goes, each application would be scruitinized better.
