For adults (man or woman) only Tetanus and MMR is needed. Children, take your child's school vaccination record; by elementary school end, this record should be complete and they will not no vaccination needed. Go to your doctor /HMO and get these done. For MMR they will say, oh, you don't need, we will do antibody assay (to squeeze more money from Insurance). Show your left hand and ask them to poke. Tetatus is IM and MMR is SC (sub cutaneous). Then and there take a vaccination report.

Skin reaction over 5mm with raised skin (induration or something). I had a postive skin reaction. Then doctor will take complete physical , take an x-ray. In 99% of case TB will be ruled out ( you see the positive skin reaction is saying that your were exposed to TB bacteria in the past - not necessarily disease). The chest X-Ray is the dignostic proof, that no TB was there at all or is not thee now. This X-Ray and Physical is on the 3rd day after 48 hours. The X-ray is not included in the sealed cover, only conclusions of X-ray and Physical.
For those 1%, don't worry. Even if you are diganosed your I-485 will not be rejected. You have to take an undertaking and prescriptions and medicines. You will be treated in 3 to 6 months. Then they may complete your case. This para is my educated, logical and common sense guess.
For a good doctor, in Denver / Aurora area of CO, PM me. Good and nice American Doctor and staff.
All you said is correct, except for you don't need Hepatitis B if you are over 16. No, there are no more tests involved, unless your tb is positive. If you tb is positive you need to do chestX-ray. There is nothing wrong in fighting. At least it will be used to prevent the same mistake in future. But it is not a bad idea to analyse the outcome so that everyone can prepare for that. My view is this campaign will be used for preventing future mistakes. I will be pleasantly surprised if we get more benefit than that. Even lawsuit also will serve the purpose and will give strong warning to USCIS.
I can tell many examples. Due to one persons misjudgment so many American and Iraq people were killed. Do you think they can get relief? Whatever relief people got it cannot bring back peoples lives. Nothing significant--still waiting for the denial letter. My attorney rcvd receipt stating that a copy has been sent.
I was lucky to negotiate infopass appointment on the spot. They can not tell the reason until they get the file from TX. They have requested that and it will take 3 weeks.
I also got to know that since I had changed addresses and files for AR11 in 2004, my I485 does not have my new address. This is per infopass. Not sure whom to believe since after filing for AR11 in Oct 2004 (changed from apt to house), I called in Jan 2005 and asked to verify my address on record as well as address on I485--i was confirmed about my new address. Also, I have been correspondence on my changed address, receipts, letters and finger print notices. Does any one ever get confirmation in writing after submitting AR11?

I believe they already answered the question: they claimed the previous allocation scheme was wrong and the current is correct. There is nothing more you can possibly get by questioning on this issue. Even if there is anything behind the curtain, that explanation covers everything perfectly and there is nothing you can do about it.
We can definitely question them on how their understanding changed on visa spill over distribution.

Dear Sirs/Madams,
Good morning!! With reference to your previous e mail talking about "living in US for 5 years, pay taxes and get a green card". Also, " living in US for 10 years get a citizenship". It reminds me that a few days ago, from the other forum, I see someone talking about the bill "HR264", there is several items in this bill. However, there is only one section in this bill mentioned about "granting green card to people who have stayed in US for 5 years or more". I do believe the chance to pass this bill is very very small because right now the economic recession is so deep that no one knows when it will be recovered.
Also, I know some people who have won the diversity visa lottery and get the immigrant visa to US to be the permanent resident and then stayed in US for another 5 years and get the citizenship.
But some people (for example like my situation) who have stayed in US and fully paid foreign student tuition fees as a foreign student for 10 years (6 years in several degrees then graduate and then back home and then come back to US to study another advanced degree for 4 years and total 10 years as foreign student) still cannot get the green card. After I finish my doctorate degree, I got a company sponsored me the H-1B visa but the quota is full and I pack all things back to my home country until now. So I just wonder when will "granting green card to people who have stayed in US for 5 years"and whether it will be true!!!!!!!!!!!!!!!!!!
I wonder whether this 5 years only for people who have worked here for 5 years in
H-1B visa or not?????????

As someone here is saying, following a GC step before Citizenship makes BS to me. You have done whats needed to be a citizen (dont go by the book, doesnt even appear there is one). They have delayed it for no fault of applicants. So this is the way to correct it.
Lets say I am 10th grade student who invented a cure for cancer. Will you oppose if MIT gives me a hon. Doctorate. That may be an extreme example but what we are asking for is something much smaller and well-deserved. After 10-15 years, the only rule should be to look at the paystubs and criminal record. Not which company you worked for or how much you were **ed by X employer. The case must just be yours independent on any employer. PERIOD.
Current economic situation.. SHOW how you can contribute. There is something called timing,. so THIS is the timing to ask for Citizenship so that you can BUY HOUSES AND START COMPANIES.. and thats how you help America to come out of this.

I am about to leave my employer and I want to withdraw my set (with wife derivative). Can you please help me with the procedure? And is it safe to leave the employer without effecting the other set where my wife is primary applicant and me as derivative.

are you sure you want to withdraw? All that you need to do i ssend a letter to USCIS indicating your receipt number. Make it clear to them that you want to keep the other one still going (mention its receipt numbers).
I would personally not withdraw simply because if they screw up and withdraw BOTH petitions, I can forget about filing another AOS for another decade...

Finally got the CPO emails/texts today morning for both me and my wife.
Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
All GC applications in EB2. Nationality : India.
Applied in Mid 2001 : company (think $15B!!!) went kaput.
Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
Applied Nov 22, 2005 : Approved Aug 11, 2010.
Labor applied via PERM - approved in about 4 months.
I-140 applied soon after - approved in about 4 months.
I-485 applied during the July-August 2007.
Receipt Date: Aug 16, 2007
Notice Date: Oct 1, 2007
At NSC.
Quit in mid-2008 with 485/EAD, sent AC21.
Got RFE in Sep 2008 (missed the 2008 boat).
485 LUD stuck at 10/29/2008 forever until today.
Opened a SR on Aug 5th.
Took an infopass on Aug 6th - all I could get was, "your application is with an
Immigration Officer since Aug 2nd". Nothing else!
Don't know if either had an effect.
Didn't do anything beyond the above two.
I think anything that's helpful for anyone based on dates/apps/process/procedures are all listed above. Now for a bit of something in my mind. No particular theme but general rambling....if you so indulge..please continue. Else Have a good day and happy life. And thanks IV.
It has been a long journey for sure. A lot of my friends who came to
USA in 1996 are now citizens. I have NO regrets at all. I took my own
path. Sometimes I used to think that if I had done the GC process
in 1998/1999 instead of quitting my full time job to do full time masters,
I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
sure, it would've taken longer to get even the Labor cleared but I would
have gotten GC in probably 2007 - and worst case 2008. And heck, I would
have made an additional $150K (since the company got acquired by "as big
as it gets" tech company). OR what if I had chosen a very safe choice out
of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
every body else got 12 offers as well]. OH btw, the full time masters ended
up costing me about $45K in credit card loans. So yeah...no point in contemplating
all the "coulda woulda shoulda"s in life.
As Nike says: Just do it.
I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
of that to the current one - where I am extremely happy and think
will over time come out very well off too.
At all times, I never compromised on my job. Took the job which offered
me the most challenge and allowed me to learn as much as possible while
working the smartest folks around. That I think was a great benefit - all
along - since that component of life (work) never bothered me. And was never
afraid of taking (apparent) risks either. To me they were calculated risks.
The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
When I quit it was 450+ folks and was about 750+ when it was acquired.
The company I joined in 2008 (via AC21), was and still is a startup. When
I joined we were 8 employees and still now, remain lean-and-mean but
kicking some serious ass. (if I say so myself..pardon me). :)
The biggest hiccup as I think of it now was that my wife was not able
to work from 2003-2007. But the EAD in mid-2007 finally solved that
problem. Oh, I never hesitated traveling either : travel to Africa (three
countries) one year, and to Europe (three countries) one year and
Asia (two countries other than India) in one year.
Also purchased a home in 2009 (it was very tempting during the
2004-2006 times...but waited out for good).
So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.
A couple of times I had contemplated Canadian PR or really
moving there or to somewhere in Europe (and even Aus PR).
But pursued nothing mostly because I was lazy.
But all along my wife fully supported in everything I (we) did.
Be it change of jobs, other big decisions..what not.
So thankful to god for that.
Just a bit to go back in the way back machine.
Long ago, labor was the bottle-neck. Then 485, then something else.
Things repeat - old is new, new is old...repeat.
There were times when there was no online checking, no sms, no email notifications.
Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.
If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.
A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

All of you guys are smart ,highly skilled immigrants.
Let me make one thing clear. Govt has defined EB categories : EB1 , Eb2 and EB3 . based on level of exp and education etc..
Now that your employer has applied for you in Eb3 even though you were qualified under Eb1 or Eb2 then govt can't do any thing. Like if you are making 70k with 5 years exp and which is ok as per your labor cert of H1b then govt cannot do any thing . Even though u r less paid compare to market.
same thing here.. If you think you can qualify for Eb2 and your employer want to apply as EB2 . It should not be issue. You are most welcome to do so. But I see common ground as HR 5882. Why dont we work hard and hard to get HR 5882 pass. One of my friend has MS from USA from top uni. with 18 years of exp from India and 3 years of exp in big 5 from USA. Still his recent employer applied under Eb3 . Should he complained to govt ???
He left current employer and found another who willing to apply under Eb2.
Unless Eb1 current Eb2 should not get any spill over same way unless Eb2 current Eb3 should not get Spill over. No matter what way you fight govt wont agree to give high priority to Eb3 compare to Eb1 or Eb2 . as from VDLRAO's post Eb2 does not need much visa to become current so if we get recaptured visa then eb2 will be current and Eb3 will get most of visa out of those recaptured visa.

Now that your employer has applied for you in Eb3 even though you were qualified under Eb1 or Eb2 then govt can't do any thing. Like if you are making 70k with 5 years exp and which is ok as per your labor cert of H1b then govt cannot do any thing . Even though u r less paid compare to market.
same thing here.. If you think you can qualify for Eb2 and your employer want to apply as EB2 . It should not be issue. You are most welcome to do so. But I see common ground as HR 5882. Why dont we work hard and hard to get HR 5882 pass. One of my friend has MS from USA from top uni. with 18 years of exp from India and 3 years of exp in big 5 from USA. Still his recent employer applied under Eb3 . Should he complained to govt ???
He left current employer and found another who willing to apply under Eb2.
Unless Eb1 current Eb2 should not get any spill over same way unless Eb2 current Eb3 should not get Spill over. No matter what way you fight govt wont agree to give high priority to Eb3 compare to Eb1 or Eb2 . as from VDLRAO's post Eb2 does not need much visa to become current so if we get recaptured visa then eb2 will be current and Eb3 will get most of visa out of those recaptured visa.

There is no specific rule regarding "EB1-> older of ...", however, DoS made it clear in the Jun/Jul bulletin that the spill-over is given to the oldest first.
BTW: EB1->EB2/EB3 is actually in INA.

Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.

We understand everyone is busy with I485 filing and have put everything on hold. But we have not put our efforts on hold in the interest of this communty and this cause. Core is working on this issue despite being busy on their own I485 filing.
We are also working with our lobbyists on CIR and as soon as there is an action item we will post it on the forum for all to participate.
At this time, do take out a couple of minutes off your busy schedule with I485 filing and contribute towards Immigrationvoice.

I was amazed to hear about the development. Would Mr. Gonzalez will show a curtsey to personally reply to all the people who sent flowers, and apolozise for the pain and emotional trauma his agency has caused to thousands of legal immigrants in this country ?
BTW, couple of years ago one of my American (citizen) friend was dealing with USCIS (at that time INS) to adopt a baby from China. When she got the baby after struggling for 4-5 years and with a push from local congressman, she was agahst with the way USCIS treated her. I still remember her remarks "If they do not understand the pain and suffering of a mother, and they do not care for a suffering orphan child, I highly doubt that they have any more humanity left in them".
The name has changed but the public face of the agency remains the same. Please remember that for them we are not human's, we are just file numbers sitting and rotting at their service center's.
So when USCIS decided to forward the flowers to our soilders (which we think is an excellent idea), its not because the agency has a human touch in it, but its because they found an excellent face saving mask for their unjust action.

I guess everybody should support Rolling and Sunny because this initative will create an opening for all other immigration issues.
Everyone waiting for years to get their GC has a real reason to think why USCIS didn't do their job right.
I would say if Sunny and Rolling stone really file a lawsuit, it is like they turning the spotlight on USCIS and from there the rest us can work to bring more light to the bigger issues with USCIS

Guys, we have already seen the Dec visa bulletin and there is absolutely no change in processing dates so its even more important to fix the AC21 issue ASAP. With this huge delay in 485 approval, more and more people will force to get into AC21 and will see more denials.
So please please, send letters.
