BILL TUCKER, CNN CORRESPONDENT (voice-over): All H1-B visa workers do not look like this. Some even look like this. Most do work at technology companies, based on the latest data available from the government, data which is incomplete but revealing, nonetheless.
Five of the top six employers of H1-B visa workers in 2006 were Indian companies. They were issued 18,453 visas. In total, almost 20,000 visas issued in 2006 went to Indian outsourcing companies, and the data shows it was not American workers who benefited but foreign workers.
JOHN MIANO, ATTORNEY: According to the Bureau of Labor Statistics, between 2000 and 2005, the United States' employment for computer workers grew by about 332,000.
During the same time period, the United States imported about 330,000 H1-B workers for computer occupations.
TUCKER: The situation for engineers was even worse, with 95,000 H1-B visas issued in the same period for engineering, yet according to the Department of Labor, engineering jobs shrank by almost 124,000 jobs.
The visa is often referred to as being for the brightest and the best. But, the visa is broken up into four levels of classifications, with levels 1 and 2 being the lowest-skilled positions, and 87 percent of the visas went to those categories. WTF is he talking about 1 and 2? how can bachelors required masters required be lowest skilled positions?
RON HIRA, ROCHESTER INSTITUTE OF TECHNOLOGY: We really don't know whether those workers are working at level one. We know that they're being paid level one wages.

In other words, you criticize NAFTA for sending so many jobs overseas, but not with the impact so much that it�s having on Mexico and on these other countries that are the other end of this free trade.

One only has to look at the empty villages in particularly southern Mexico to examine the impact of the agricultural policies within NAFTA. One only has to look at the maquiladoras across northern Mexico to see the impact on a society that is already 50% impoverished, education levels still where they were thirty years ago in Mexico.
But my perspective is an American one. And I won�t presume to speak for Mexico, as Felipe Calderon does presume to speak to the United States for Americans on American policy. The reality is that NAFTA doesn�t work for this country. It doesn�t work for Mexico.
But I am not one of those people�as Amy was talking about, my detractors. The suggestion I�m anti-immigrant, for example, is absurd. I would support an increase in lawful immigration and have said so repeatedly and have no problem whatsoever with current levels of immigration, which, by the way, are the highest levels of immigration in the world�in fact, more than the rest of the world combined. We bring in more than two million people. But the issue is one that the United States does not have a foreign policy toward Mexico. I am not aware of anything that says that you need to bring this up initially in your job search. I personally wouldn't put it in my CV.
Apply for a job, as you would if you had a green card (keeping within the AC21 parameters.) If the question of visa sponsorship comes up then you can say you do not need it. I am not sure why people bring this up with their prospective employers. If you have employment authorisation, you have it, it is not employer specific, it is not site specific, it is quite broad in its scope. The employer
has to complete the I-9 like for anyone else. Any issues would be with the USCIS at the time of adjudication and that would be if AC21 rules are broken.
I think that sometimes we project our own fears onto employers and make issues when none exist. I've seen the same sort of doubts expressed about AP travel.
Folks need to grow more confident generally. For many their immigrant petitions 140s have been approved and their 485s have been pending for quite a while. They give you these interim benefits for a reason, so you can use them!
Not sure if you are in the IT field, but a reqruiter/HR is the first interfacing person. No matter what, these are the first questions you can expect when a reqruiter calls you.
dice.com, monster.com etc... wants you to select from a dropdown what your status is and in most cases, employers/reqruiters filter reesumes based on that criteria.

So they approved your case even before you could reply to the RFE?
Well I got RFE then within a week got Card Production ordered email then within 12 hrs got mail undelivered email..
I have not replied to RFE yet.

A# is the alien number that is given to the applicant during the GC process. It is either given at 140 approval or at 485. If you have a A# in your 140 approval then you can use that # in all your 485 forms.
To answer pranju's question, yes its only for primary applicant. You can leave that field as blank for your spouse.

The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.

It should not matter when you file as long as your priority date is available when you file - and of course you need to be in the country when you file it (to be on safest - i would be in the country on receipt date until I get my receipt notice).
Having said that, I am not sure until when June VB will effective. I mean I do not know when July VB dates will take effect. Probably someone else can clarify this.

I am surprised to see the list compiled by Sanjay b that all the pendig applications are received in the same time frame and received by J. Barrett. Do you guys think this package of applications is mispalced or something?
CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.
Couple of things...
1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

I am surprised to see the list compiled by Sanjay b that all the pendig applications are received in the same time frame and received by J. Barrett. Do you guys think this package of applications is mispalced or something?
CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.
Couple of things...
1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

Any benefit in filing 485 on the first week of June versus last week of June? Any FIFO implications?
Yes, the I485 filing fee will be tripled anytime, the longer U wait the more likely it is you have to pay the increased fee. If you are family of 4 it will be 4K just in visa fee + Medical + lawyer fee...etc:(

I am not sure if I am correct, but I have heard it is totally up to you what form to use when re-entering the U.S. If one posseses a valid H1 and AP, it is up to him what to use. Many people choose to use H1 to enter to safeguard status while I485 is pending. I may be wrong; but I could swear I read about this some time ago.....

My I140 is approved and I am a July07 filer of 485. In July08 I moved to self-employment after consulting a good lawyer. Now my previous employer withdrawn I 140 and today I got 485 denial notice. I didnot filed AC21 as lawyer told it is optional.. :mad:
