Thanks. she is still working for the same employer who sponsored her H1. Now, she needs to continue maintaining relation and continue working for them.
I am still worried though.. I read in this and other forums that USCIS may issue RFE asking for proof and if says medical leave, then asking for medical records etc.. So, better to prepare for some 'solid' answer with out any loopholes by being honest. I do not think lying would help and may lead to more troubles.
It means, if at all they have any doubts, they may issue RFE, but if you have a good relationship in responding to those RFEs using company letters etc, there is no problem. Good relation means, employer has to suppprt you always in case of any RFE, thats it. He needs stand on your side. Then there is no problem. But if he won't stand on your side, then it is a problem. So, thats why relation with employer is very important when on H1 or EB.

Get the appointment with your congressman by yourself and then try to find company to go with. If you cannot find anyone who can go with you, then go alone and do your thing.

Can anyone tell what will be the status of a person who has used AC21 , and does not get the EAD renewal before the existing EAD expires ? Assume 140 has been approved, 180 days has been passed and got the EAD renewal receipt.

ramus, follow my posts in the past 20 days and you will see i have posted many posts for this AP expedite. I have a travel coming up shortly and I had only exactly 90 days from the date of application and date of travel. My application was approved recently along with my spouse. There is even a post where I listed out all the steps I took to expedite and finally finally only the local congressman phone to USCIS helped. its just unbelievable, but its possible. I have tickets that even if you postpone the journey I will lose money. I said to myself enough we lose with USCIS, and so decided to take all and any steps to expedite and get it done. just follow my posts (like start reading my past 20 posts) and I am sure you will find it useful. There are only 2 possibilities - you get RN or you don't get RN
1) You get RN. Congrats you got your - rather overpriced - lottery ticket. Winning the lottery is still far off. Considering 300,000-500,000 apps and 140,000 numbers, chances of winning it soon is as slim as the chance of getting struck by lightning. You might as well laminate it and hang it on the wall.
This will be the only piece of notice we will be seeing for many more years. Unless, of course enough of us get over our collective OCD (Obsessive Compulsive Disorder) over RNs and concentrate of real-life action.
Moral of the story : RN is a lottery ticket. Keep it safe. But, don't mistake it to be the prize.
PARTICIPATE.

I am not sure either way, however I have heard the FBI comment that they only flag a small fraction of cases. IF that is true, then the USCIS may just be using the FBI as an excuse.

Well according to NSC they have completed processing of I485s upto Aug 2006 RD. They take only one year (and often less) to process I485s.
Pending I485s with earlier RDs are due to two reasons 1) retrogression and/or 2) FBI namecheck incomplete.
However, restrogression cannot cause wasted annual visa numbers. But FBI delays does. I doubt USCIS is passing the buck to FBI. It is a fact.

It is not true that Many people have to wait 10+ years to get gc. May be some people might wait for 10 years because of frequent change of jobs , layoffs and also ignorance of green card processing. Most of the time EB2 waiting time is 2 to 3 years. Indian EB3 is in worst situation but only for past 2 years and before that everything was current. For that also most waiting persons filed I 485 because of July VB issue. In my opinion EB3 PD will be backdated up to 5 years.
Also there is no legistrative activity in Congress about any immigration issue. Always skil bill comes in limelight when congress is in Session. But everyone knows that skil bill is asking too much in H1b and immigration numbers because of exemptions and it will be very difficult task. But no one in pro immigrant community is ready to compromise on numbers. When Congress tries to curb the abuse of H1b even pro immigrants are opposing the bills without any suggestion of any alternatives. If some bill comes for only GC that too moderate increase in numbers that will have bright chance of passing in congress.
You should not expect any rally will produce meaningful reform. It has to be proved that additional immigrant and H1b numbers will produce more jobs and it should not create unemployment in americans.Just sufferings of gc waiters is not enough. My opinion is Rally will be used to show strength of IV and may educate public and Congress. But anti immigrants also doing Similar Campaign(not big rallies) by negative points of immigration. if you have seen my other posts on this subject, you would not have said what you did. I am an IT consultant, and, have in the past received multiple offers for labor sub, but, not taken it as I am comfortable with what I am doing.
I have also personally known people who used labor sub in companies that are listed on the NASDAQ and are involved in Software development (not one of the mom and pop consulting companies)
All I was doing by playing the devil's advocate is trying to deflect the heat of the person who started this thread. I will repeat myself once again. I understand that as a practice it borders on being unfair. However, if it is being used by someone legally, to better their own life, we should not come out and attack them.
Now to answer your question - "Would you do it? If yes why and if no why not". Would I do it? Yes I would if I got an offer from a great company with a well defined career path, good salary and stock and benefits etc.
Would I do it to go from one consulting company to other by paying someone money for it? NEVER. I hope this answers your question.

That is wishful thinking.I know people with more recent priority dates got cleared in june but it will go back to PD system from now on again,how else can they do it.The reason why (to eveyone's surprise) they made everything current was to clear some of these cases which were filed long ago(I-485) but were stuck due to the retrogression.This is obviously not going to happen again for sometime since they now have hundreds of thousands of more cases.
I think this will happen again but only in the last quarter when USCIS has to utilise all the visa numbers .With the fiasco that happened in July ,there will be a substantial movement in PDs for June 2008 VB or in the last quarter as they will want to approve cases which have been cleared but cant be approved due to PD not being current. So we will see this kind of scenario almost every last quarter. Also there is a high probablity because
1. they would not like to waste visa numbers .
2. USCIS in under the pressure for media to work in a more efficient manner and justify the fee hikes
3. this also happens to make some people from the immigrant community happy ( atleast something is happening rather than nothing is happening)

My I-140 was denied incorrectly , as a result my I-485 was denied.
The USCIS is claiming that the I-140 Petition was filed without a certified PERM application. This is absolutely incorrect. The original certified PERM application was filed with the I-140 Petition. I have a photocopy of the original PERM application.
My lawyer filed MTR for both I140 and I485 6weeks ago.I received receipt notices for both I290B.
