Thanks for the contribution, you can call or PM any of the core members and you will be assured that every cent is being used for the common good.
Yesterday I signed up for recurring payment of $50 per month. I already donated about $300. Will someone tell me it is being used for the common good to make me feel good ?
Thanks,

What are you saying he has no valid visa on his passportm his papers are valid. People who have a valid I-94 and like H1B - Valid i-797 can legally work in US without a valid visa on the passport.
Well getting a transit visa to france depends on the rules the French government has. Ask your travel agent.

I am a dentist in state of CA,and filed for EB2 green card.In April
2006 applied for my
PERM from MD Dental, a dental group with 5 offices and about 30
employs and owned by 2
partners. Also in April 2006 they applied for my H1b visa.Further PERM and H1b
both were approved
and in may 2006 I filed for I-140 from the same company.I-140 had a
RFE but was approved
in Feb 2007.Meanwhile in Oct 2006 both partners had a misunderstanding
and they split the
company into 2 companies with one partner getting 2 offices and the
other partner getting
3 offices.Originally my perm was filed from the MD dental Van-Nuys
office, which was
given to partner A who then told me to file for a new H1b as tax ID
number for the
employer has changed but my job location would not change.I filed for
a new H1 visa from
partner A which was also approved and started to work for him till Feb
2007.In feb 2007 I
found a new job again as a dentist with a different company and moved
to that company.I
am still in good contact with both partner A and partner B of the old
company.
My question is if I could file for I485 from MD dental which is
already split with
approved I140, or I could file it from partner A or partner B`s new
company showing
either of them as succesor of interest. Also can I invoke AC21 in 6 months and move to my current employer..
Please advice.

Hi Gurus,
I want to switch my employer after my I140 gets approved. I may not be able to apply for I485 because of the Retrogression.
I have read somewhere that the priority date can be retained by the beneficiary once I140 is approved. Even though I restart the entire process from LC application, I can still hold the old priority date.
Are there any catches in this rule.
Please advise me.

On reading a bit about PIMS, it seems that if your information is not in the KCC, then the US consulate sends a request to Kentucky for information. It turns out KCC has access to the CLAIMS3 system used by the USCIS, and they generally respond in 48 hrs. Here is the link:

If we register our marriage in the US, say, today, wouldn't that conflict with the marriage affidavits we submitted for H4 etc? Those bear the wedding's original date.

Thanks for sharing your different experiences. I feel relieved now. I'll check with my lawyer on Monday just to make sure he knows about that potential issue. You've made my day.

Folks! MSNBC is organizing a gut check on the immigration issue (though this appears to be on issues related to illegal immigration). It's a message board inviting opinions on immigration with an expert panel set to reply to the meesages posted. Eventually, messages will be short-listed for publishing. We may be able to make an opportunity out of this.

That explains it.If your company is blacklisted you are in a deep hole and should have a backup plan for employment. You should consult more good lawyers.

First let us get USCIS to process our applications strictly based on PD. Then we will have more people for the rally because new PD date members would be more motivated to participate in the grassroot effort

What did your lawyer say about this? Now you have a delivery confirmation, did you lawyer suggest that USCIS consider the dates as of last year and process your resubmitted application. Certainly it is not your fault,,
They said that they would request an exception in our case. We are going to request that based on our original submission date that our pending case have a current priority date. All dates were current for our case up until the April visa bulletin.
I am really hoping that USCIS sees this error. Has anyone had any experience with USCIS? And were they cooperative?
thank you for your reply.

A good employer and a good law firm will not have the dirty deals of trying to screw an employee.
It is true that Law firm is not obligated to answer employee on 140 because it is an employer petition and they may not act against wishes of employer, BUT if they are good people and have some ethics they will send a photocopy to the employee for his/her records.
FOIA takes time, but one will eventually get it through that channel also.

If you have GC then you can take out ur 401k in 2 installments (because u have RNOR status for 2 years) and file tax as a resident in USA (because of GC).
If you don't have GC then please take all ur 401k in one shot in the year you leave. Otherwise you'll pay 10% penalty and then 30% tax to USA because you will be a Non resident as for as US is concerned in the next year.
As a non resident, if you take out 10K every year, you should be under the Standard deduction and thus owe no tax??

Anyone travelled recently through Germany (Frankfurt) using Advance Parole? Any issues with Advance Parole while coming back to US? Do we need transit visa? Appreciate your response.
Please visit the old thread, you will find lot of information about this issue.
http://immigrationvoice.org/forum/forum5-all-other-green-card-issues/25671-transit-visa-at-frankfurt.html
Also take a printout of the information from the Website (http://www.germany.info/Vertretung/usa/en/04__Legal/02__Directory__Services/01__Visa/__Transit__Country__List__Visa.html) (German Consulate Website).
I hope you have already searched the threads for the information you are seeking and then proceeded to post your issue.
I don't know IV policy but if we have an existing thread then please re-ignite the thread by posting your concerns which are missing from the posting. This way we can have single thread for single piece of information. Right now we have scattered threads for unique issues, same information gets repeated several times.
Anyway have a nice vacation, don't worry too much about it.

i have sent him about three emails. The response is the same - word for word. If they see any immigration related email from a constituent, all they get is this canned response. Sen. Conryn is anti-immgrant for all I know and care.
Could be true...
However, it is better to get a letter that actually relates to our problem instead of a standard letter talking about amnesty

startup visa is the most horrible of all the ideas..... this subject is like a hidden enemy of all immigrants waiting in the backlog ..... is anything like this would pass..... the congress will tell everyone that entrepreneurship related immigration issues are all fixed.... it will be hailed as the biggest victory of american capitalism & congress will forget @ those stuck in the backlogs..... the reality will be that is just another way for those 170 venture capitalist to rake more....
some reporters write these articles with no knowledge of the subject.... & with little or no research of their own....
Why do you think it is SO horrible? Suppose this comes up for debate, we have an opportunity to revise the 170 VC's clause or maybe water it down some extent. If we are not able to do that, even then sometime in the future we could work those screws and try to loosen. At least it gives a segment of our community a chance to clear the line.. just my thinking .
