So you mean that EB2 petitioners are not required to file affidavit of support (either I 134 or I 864) at all for their spouse who are on H4 visa....
Any employment based petitions . You can send that as a supporting document but not mandatory .It wont comes under " initial evidence"

This is one of the key reasons why we are not successful in our mission. All we can do is "lets kill H1/L1 so I can get GC", "lets not worry about EB3 as long as my EB2 is fine!". The only way we can make any progress is to stay united. Lets not try to find carrots that would really be sticks on people who are also part of this cause.
EB3-I and EB2-I are both the same. EB3-I can port to EB2-I when the PD comes near. This is a normal human tendency and anybody would like to do it. The present EB3 guys are just waiting for the EB2 PD's to progress and they would move to EB2. I don't see anything wrong in that.
Lets come up with some action plan. Maybe we can draw the media's attention or send letters to our lawmakers and white house.

It is not true that all the H1bs are creating jobs. For one example I worked in a big garment company and they laid off hundreds of people(around 800) 4 years back and did offshoring 90% with 10% H1b and L1 to Infosys. This would have created less than 10 new admin jobs for setting up office here but it displaced 800 jobs plus all the new projects(jobs) go to Infosys and US government lost millions in taxes for a private company to save a few million dollars. But if a H1b is a real innovator or investor then he could create scores of new jobs but those guys are very less. They should be identified and rewarded by faster GC process.
But real intention of H1b when it was created was to fill shortage of skills but not for competing with citizens in rate. If the real intention is to compete globally then that needs to be revealed while lobbying with Senators. There is nothing wrong with immigrants or H1b persons. Most abuses are done and enouraged by employers. Corporations prefers a person always to be in H1b so they want more H1b quota and less gc so that they can exploit people.
Basically H1b numbers and offshoring needs to be increased when demand is high(Really it was needed on 1999 and 2000) and it needs to be decreased when demand is low. Also today also there is shortage of skills in a few areas. System should handle those also.

Who is a freeloader ? (Say) you started contributing $25 per month 3 months back, contributed $75 till date and I have contributed $200 till date towards two specific drive .... so a person contributing $75 calls a person contributing $200 as a freeloader !!!
I agree. Lets not start using negative terms. People have been contributing in ways they see fit (providing info, answering questions and one-time or recurring donations).

In a Gandhi-inspired protest, foreigners working legally in the United States sent thousands of flowers to a top immigration official yesterday to draw attention to their complaints about job-based visas.

What I am suggesting is that the right time to take this up is when a recession is not in full swing. Between 2004 (when this law was enacted) and 2007 was a great time to pick this battle. Maybe another year down the line would also be a great time to pick it. Picking up this particular battle right now would probably make YOUR and MY lives much more difficult in the medium term.
I disagree. By not reporting the fraud at workplace, it puts rest of workforce not at level playing field.
Like you and the OP - I am a selfish individual. I will pick up only those fights which are in my interest. I believe that this particular fight is a lose-lose proposition in the current climate. I am disputing your (and OPs) belief that this will be beneficial for you/me/rest of us.
Lets take the example of the same Goldman Sachs manager. Tomorrow ICE comes to him and says you need to get rid of these 50 guys under you. What will he do? He cant increase the budget in the current environment. So he probably will hire a couple of GC holders/Citizens and replaces the whole division (with 50 GC/Citizens besides the 50 'violators') with an offshore team.
You are right. If you are not impacted by fraud, one will be least interested in reporting the fraud. Only when you get impacted, the fraud appears real and serious.
To give you example, There are only 3 people on H-1B at my workplace and none on L1 visa status, so no one cares here about this issue.

Hi Folks,
In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.
Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?
From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)
Any comments ?

It is WAC and was approved in Mar 2007. My earlier two H1 petitions were from EAC. I have two H1 transfers in my H1 history.

My attr said that uscis does not follow any chrological order to approve cases. Rather, it takes any 485 application filed before Jan 22, 05. So, your point on "giving more time" won't work here.
This is what I did. I did not get GC yet though, but got to know where I'm at.
1. Contacated NCS numerous times and raised two SRs.
2. Took inforpass a couple of times. Infopass IOs have more detailed info about our cases.
3. Contact Senator requesting that my appln be assigned to an IO, and it was done so. It is with an IO now. Hoping and praying that my IO picks up application to approve it this week.
4. Contacted Ombudsman late last week. Hoping to get some good actions taken on my application.
5. You might consider contacting Janet Napolitino as well.

i got no email, no slip, so i dont know if its stuck in PIMS or some checks ???
And if its really NOT PIMS and something else, then how long does one estimate ?? how long could an administrative processing take ? how long could security check take ? how long could name check take ? etc etc..
