My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.
Thank you for your information.I hope you know the situation right now in USA.In jan 2010 H1 people came to Newark Airport were asked to form in a separate queue as soon as they get down from the flight for two levels of interview. Some of them are sent back. Now you can't find employer to transfer your H1 immediately. Before two years it was possible to transfer H1 with out having recent pay stubs and they never asked client letter. Now if you don't have a job you can't transfer your H1 to anybody.
Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise
Where are you located?. East bay?

I just read in Murthy.com that if a H1B is terminated and the same company wants him back they have to pay the entire salary for the period he was out of job. (google H1B employers obligations) So i think that won't be your case. You should be on EAD.
When you are on EAD they need not inform USCIS. There is no need for you to join your old company back.
Correct. But it's surprising that my company wants to inform USCIS about my lay off even though I am using EAD to work with them.

Okay...looks like you are in the same boat as me. Can you please check with your attorney and let me know what he/she has to say??
Thanks!
The visa in my passport expired 4/2006.
Currently I am on my 7th year (which I do not have stamp for since I did not leave the country in a while) which ends 4/2007.
I just applied for my 3 year extension (8th, 9th 10th) which I hope to get approved in Feb before I leave.
Thanks!

my PD is April 2006, so i guess i would need to wait 1 year to get the dates moving, since it would be quite a huge backlog clearing up
any guesses when it would move next
It will move to Sep 06 or Dec 06 in the next bulletin for EB2-I, and March 2002 for EB3-I. Don't ask how I know this -- Ask Q

Important Note - I think the fine print of this bill was discussed a few days/weeks ago and the visas will actually be going to recent grads (within the past 5 years). It will in now way help the EB2's and EB3's who are waiting in line forever.
I think this is the right time to work on modifying the text of this bill. If not these GC's will be given away to people who haven't even applied yet !

I think ppl who have masters or above from accredited US university shouldn't have any visa restriction; meaning they shouldn't be counted towards their country quota. No cap for Masters from US University -:)
P.S. I don't have masters from US.

I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.
Pls. let me know urgently of any such cases and I will follow it up. This is required today and we have a short time window.
Two of my colleagues went back to India after facing GC hurdles. Among the two one is Phd in Atomic Science and Computer Science and lead a group of people and another is a Project Leader.
In the first one's case it took more than 4 years for him to clear his labor and got frustrated by this process. He initially sent his family back to home because of uncertainty. That created more hurdles for him as well as his family could not able to get AP in time and he is nearing completion of his 6 year H1 as well. Eventually he decided to pack his bag and went back to his home country, setup a big business and now visiting US on business Visa and take some of the jobs from here to there :)
[Side note: His approved LC remains unused at the company end even now, but finding a suitable person seems to be an uphill task for the Management and HR]
In the second one's case his labor took almost 5 years to clear and having frustrated, he decided to go back as well. He does not want hang in a place where a decision cannot be given in a timely manner. He got some special technical skills and his roll is now being replaced by 2 people. He also went back to his home country, joined a big IT firm as a Director and getting more jobs to be outsourced there :)
In both the cases, US is a clear looser by not taking advantage of the skill sets they have.
If you need more information in specific kindly send me a PM to respond you back.
Thanks

Subject : Legal workers' immigration issues in CIR
Dear Sir/Madam
In CIR, please address legal workers' immigration problems.
Legal workers are waiting for GC for years (decade or more in lot of cases) because of unavailability of visa numbers. These law abiding people and their families suffer financial, social and many other hardships due to broken immigration system.
Thanks you.
Sincerely,

I think its more than 3 since I got a notice about my 2003 state taxes in 2007 which they said they never received and I got stuck with a penalty ( although I was getting a refund ). I paid the penalty since it would have been too much of a hassle to go through 2003 records and then duelling it out with the IRS.
if you get a refund and you refile you should not have penalty....?

hmm..
looks like I might be able to claim my parents
they are here since july last week..so around 160 days this year and were here last year for 3 months, so one-thirs of that is 30
so have a total of 190 (which is more than 183)
Substantial Presence Test (http://www.irs.gov/businesses/small/international/article/0,,id=96352,00.html)
Does this have an impct on the GC though ?
I mean, I see that is a prefectly legal thing to do but does USCIS have a problem with that....
