    If you have a 3 year H1 extension (like I do now) you can get a stamping for 3 years and wont get tied up in AP extension filing etc. With the flood of applicants in July I think USCIS is going to take much longer to process AP/EAD and I am expecting periods between APs where I would be stuck, unable to travel. With a 3 year H1 stamp all those issues go away.
    Traveling on AP also has the funny effect that your I-94 would be stamped to the expiry of the AP (1 year) rather than H1 (3 years) and I dont know what happens when that I-94 expires... H1 travel is simpler once you have a long lasting H1 stamp. Main advantage of AP is I can renew without leaving the country and if my I-485 ever gets approved when I am outside the country, I can re-enter (my H1 would be invalid at that point)

    Thanks, that explains. I realized only couple of weeks back that i didn't need AP since my H1 stamping is valid until 2008 end and hopefully my GC will be approved by then. Anyway now i have backup since my AP also got approved yday.
    btw, i read somewhere here that when your AP I-94 is about to expire you ammend that with your H1 so you will have the H1 expiry date.

    Same thing with me. I have mailed my EAD renewal application to phoenix lockbox on 19-May. Checks not cashed and no email from USCIS yet. Not sure what's happening and why the delay.

    Last time around exactly the same time in 2006 CIR took off like crazy because of the tremendous backing of Senate Judiciary committee chairman Arlen Specter and Senate majority Leader Bill Frist (who actually gave a deadline for a the bill to be introduced to the senate floor, to speed it up) and president bush supporting it as well. In spite of all these it took the senate from Feb-march 2006 to around September 2006 to get it passed.

    Now to the present situation, Harry Reid, the current majority leader never ever publicly spoke one good word about CIR, the present senate judiciary committee chairman, Patrick J. Leahy has not displayed even 1/100 the urgency nor the interest in CIR, president Bush though still supporting CIR is a wounded president licking his wounds and has truly become a lame duck president (most unfortunately for us).

    Having considered the above facts what are the chances of CIR happening? Its very painful to say that but I think very low. Even by a miracle (a very big miracle at that) if something happens it will be November or December 2007 before it passes.

    As if this not painful enough there is a 60 day waiting period from the day the president signs it before it becomes a law. I think there is some confusion on this 60 day period (I am not 100% sure on this). In addition to it if I remember correctly there was a strange condition which was something like there would be a 6 month investigation period to determine the effects of CIR before becoming a law. If you add all this nonsense up I think in the best case scenario January or February 2008 before CIR becomes law and worst case scenario July or August 2008 to become a law. just my 2 cents. I can only pray and hope I am wrong.

    There are some inaccuracies in your post:

    The CIR in the Senate passed on 25th May 2006. Bill number S. 2611 of 109th congress. (See for this on thomas.loc.gov )

    The 60 day waiting period is something that may be removed this year as this year, the Dems are in control.

    I can go on and on about why CIR did not become a law in 2006. However if one were allowed just one phrase to describe the reason why CIR didnt happen in 2006, is : United States House of Representatives (http://www.house.gov/).

    If you remember, in Nov 2005, the house had already pass its own CIR. They called it CIR, but no one else called it that. Its was H.R. 4437. Created by dear Chairman Jim Sensenbrenner. The bill provided for making illegal presence a felony and basically deporting 11 million already here. That was the House's CIR.

    What happens this year, even God cannot predict. What we've said here at IV, is CIR will come in SENATE, in March-April. It will be debated and passed in Senate, most likely, just like last year. After that, as far as the House is concerned, it remains to be seen how much pressure the White House and Senate can put on them. Basically, if the White House were to direct a few more raids by ICE on some meat packing plants and some construction, that's all it takes for the House to be shamed into doing something about a widespread problem unless it wants to be called a do-nothing congress.

    Now we cannot predict if the above course of events will take place. Its impossible to predict. Some people (on other sites) have laid out percentages like 20% chance this will happen, 80% chance that will happen. That's really laughable.

    if u have a valid H1, plus a valid stamp...empoyer may not give u 485 receipt as u can re-enter w/o prob. Just on H1

    However, if ur H1 VISa stamp is expired..u have to either use AP (which was not filed, so cant use) or get VISa stamping fresh appt.


    The regulation above says you need H1 stamp AND original receipt notice of your I-485. So if you have to travel abroad, you should be able to ask the receipt from your employer.

    3/ How likely is it that PACE will become law?

    Extremely likely. It is a bill with bipartisan support (almost equal number of Republican and Democrat co-sponsors). Plus, there is tremendous political will in Washington DC right now, cutting across party lines, to enact a legislation that will maintain America�s competitiveness in science and technology. The traditional anti-immigrant lobby that usually shoots down such legislation is also not too bothered by the automatic adjustment of status (AOS) privileges (i.e. a GC) being provided to PhDs, as the total number of PhDs is too miniscule a number, and seen to add tremendous value to the system for even them and their prejudices to oppose it. The total number that will be given these benefits under PACE will be a few hundreds, and this at a time when there are bills in senate and congress to legalize the 11 million (i.e. 11,000, 000) illegal workers living presently within US borders. Please know that the PACE bill is inspired by the highly regarded National Academies report that came out in the latter half of last year, and therefore has very strong credentials backing it. The only thing we have to do is to get these minor amendments incorporated into PACE; otherwise the bill will be passed and we will be left high and dry, and there won�t be as good a chance for us in the near future to get that elusive green card.

For these immigrant workers, loss of jobs will practically wipe out the immigration opportunity. The longer the visa retrogression period lasts, the harshier their journeys will be. What about those new foreign workers who have yet to look for a job and start the immigration journey from the scratch?
    Under the circumstances, all one can hope for is a short-lived economic recession and a turn-around of the country's political landscape in favor of immigration.
    Year 2008 may be recorded one of the harshiest years for foreign workers. Immigrant workers, be prepared!

    hi mirchiseth, I recently applied AP to wrong location. I guess some one had the same situation while back. Do you remember how did that fixed.
    Basically my case is pending at texas, but i wrongly sected missory and so my receipt number says MSC, that is what i realized that it was efiled to wrong location. Any help in this would be appreciated.
    I also took infopass appointment to check, i am not sure if i get help with out getting the confirmation receipt as i efiled yesterday.

    There is a cut-off date. Until then they forward those applications to right center (it may take a while), check when is that.

    My priority date is June 2006.

    I was with consulting company till 06/2009 after which I joined the client (fortune 10) company as full time employee. I'm on EB3 category using my EAD.

    When I was with consulting company before I left they filed for my EB2 labor which is now approved.

    Here is my DILEMMA.

    OPTION#1) I can join my previous employer. i.e. the consulting company for interfiling between EB3 and EB2 so in which case if I go for premium I140 processing I will be on EB2 within a month or so.

    BUT I'll have to leave my current full time employment which is with a fortune 10 company and good pay, I'm not comfortable to leave this position AND I do NOT want to loose the opportunity of getting my GC as soon as possible as EB2 dates are so close to my priority date.

    OPTION#2) Discard the approved EB2 labor that my previous employer (consulting company) have for me and ask my current employer (fortune 10)company start my EB2 PERM labor and premium I140 and then interfile. IN THIS CASE, it might take about an year for me to get on to EB2 category BUT by then I'll miss the EB2 train if the dates become current before I get on to EB2 category....

    Please provide your advice/inputs on what options I have, Do you know any other options than above specified.

    Has anyone gone through this situation and how did you handle?

    Any other feasible ideas that help me keep my full time position with fortune 10 company and as well get my GC on EB2 category.

    Does any one know how mant days it takes to get denail notive .I-140 denied on April 22 and says notice mailed but didnt recieve yet .Both emploter and attorney havent recieved any thing yet .Is this Normal ?

    You should call USCIS to let them know that your notice is still not reached to you, so incase if it's stuck on the way, they could send another copy.

    They will not care for us at all! But, there is an outside chance that one of the retrogressed is related to one of them or somebody knows a politician... and our e-mail also reaches them at the perfect time! And, one of the concerned politician/minister happens to meet one-on-one with Karl Rove, or any such powerful figure in the Bush Team! And, they bring it up with the Bush Team, who assure them they will make Retrogression disappear!!!

    ;) Hey, if we were so lucky - one of us might have won $365 mil Powerball, and donated $200K or more to IV outright! I would have, I know that for sure!

    Instead of asking for more bread, we are fighting ferociously for the scraps like dogs!

    It was estimated by Compete America that if the last CIR had passed there would have been more than 500,000 visa numbers recaptured ( don't ask me for the math, I didn't come up with this number). Assuming that the Nurses took away a chunk of it, we still would have a big chunk to statify Eb3, Eb3, ROW, India, China etc. etc. And the nurses are going to walk away with a big chunk folks - whether we like it or not - because we are fighting each other like dogs for the scraps of the spillover, while they will come up well organized and walk away with the cake.

    Our disunity, lack of long-term vision, lack of action is our biggest weakness. We will not win unless we fight this together.

    For the August visa bulletin, USCIS gave all the extra quota to EB2. I don't think this is fair for all the EB3 people. I thougt the reason they gave all the quota to them was the EB2 included NIW. But NIW is just a small portion of EB2. Majority EB2 peopole are like EB3 working for companies and not necessarily important to give all the extra quota to them. If the policy continues, our EB3 will just become fake immigration. You don't know how long we can finalize our case. Gugs, please work together and let our voice to be heard by USCIS. Hope our organization can help us.

    I am in the same situation right now, called both SFO and SJC airports and they seem to indicate they do not know anything about it. DVB how did you handle it ? Also, will it affect my status being on expired I-94 ?
