I think we need to have a thread to report the name of such companies...
That actually might be a good idea. These companies that mess with employees and take advantage of their visa status, should be taught such a torrid lesson that any other freakin desi consultants will think twice b4 messing with their employees. It's a sad thing that we Indians exploit other Indians in the name of "It's JUST Business".

I called too. They told me that NSC needs 2 month to process it--presumably, getting the FP notice out to me.
incompetence of USCIS is beyond comprehension.

You gave me EAD, you gave me AP, you gave me receipts......why did you put me back at the mercy of NSC again? WHYYY? you knew they suck!!!

I hope once DOS decides to change the spillover and give the extra visas to Eb3 (whoever ROW , India....). The ensuing discussions from from the self glorified EB2 crowd here would make for an entertaining reading. I would like to see how much they enjoy the predictions after that.
Changing to vertical spillover will NOT help EB3 India or China. EB3 ROW is not current and it will suck up all overflow leaving EB2I, EB2C, EB3I and EB3C to their annual quota only. USCIS changing the process to horizontal spillover is the best thing that has happened to I and C community in the absence of immigration reform. Now there is at least some hope for EB3 folks to get a new job and apply in EB2, as at least that queue is faster. If we fight among ourselves and stop vertical spillover, it will only benefit EB3ROW as they will get all overflow from EB1 and EB2ROW. Please guys, let's not fight.

I will use it surely when I come across a good opportunity. This is a provision provided by USCIS just for the specific purpose of changing jobs, so why do you anticipate any issues with using AC21 with in the guidelines for using it. I would also consult some one (best one will be a lawyer in my view) who has done this and has good knowledge of this to make sure everything is in order. Best of luck and enjoy the little flexibility AC21 provides.

Received 1 year EAD.....though PD is not current!

EAD Card production ordered as of 8/19.
E-filed: 7/11
Receipts: 7/18.
No Finger printing notice received. This was at NSC. Mostly will get 2 years EAD as my PD is nowhere near to current but will update everyone for sure once I receive the cards!

I guess MOST of the people are concerned about the quality of photos than $ spent. My friend had RFE because the photos he got from CVS were not upto USCIS specifications. So any + experience is valuable to the forum.

Personally I do think if DREAM ACT is passed, it will be easier to voice another bill to be passed to allow legal working immigrants (EB-1, 2, 3) to get green cards. I said this based on logical reason----people from DREAM ACT are illegal immigrants, so if DREAM ACT is passed, illegals will be turned into legal immigrants. So by logical reasons, legal working immigrants gain legal entry to US for jobs or for schools before, they should get green cards by logical and reasoning approach because they have paid taxes and expensive international tuition fees for years to help the US economy before.
Also, since NOT all EB legal working immigrants have US advanced degrees in Science & Medicine, therefore, similarly by logical and reasoning approach, any US advanced degrees in Science & Medicine graduates should have a chance or path to get green cards or to start up companies in US to help the US economy better. that was a very interesting read. Another scary part is that it took USCIS 6 months to revoke teh I-140 from the time it was requested. Meaning when he actually left his employer, if he had called up USCIS to verify the status of his I-140, it would have come up as still-valid.
Moreover, the decision totally ignores the fact that "The basis for adjustment is not actual (current) employment but prospective employment" and the entire answer to Q10 in Part I of the Aytes Memo od 12/25/05

2. Since the spillover also includes Family based to EB, this even more complicates the above issue.
3. Well, administratively it is easy for CIS to issue the spillover visas once at the end of the year, rather than do 4 times a year at the end of each quarter. I guess less work with the same result...

This discussion should scare many many people. I can count so many people just over the top of my head who would have a similar problem.

I came in US on 06/03/2001. When I came I was told, no project for me right now and I have to wait. I waited till 09/11/2001 WITHOUT pay.
The first time I was on my company payroll was in 09/11/2001. Since then as of today I am working continously.
AM I IN PROBLEM?
Please comment and give me hope.
