    nmdial I dont think the registrar will issue a birth certificate based on affidavit from the parents.
    Usually for people who dont have birth registered at birth or hospital records we have to obtain a non-availibility certificate from the local authority. Along with this certificate we submit a notarized affidavit signed by one/both the parents. Now we have learnt that this affidavit has to be signed in the presence of the registrar. Hopefully that should be ok then.

    My parents had submitted a notarized affidavit to the registrar (death and birth) of the local municipality and obtained my birth certificate. That was in 2006, the rules may have changed by now.

    4/ How can we be so sure that the amendments we are suggesting sound �fair, reasonable and in US interests� to senators and congressmen?

    The amendments we are proposing are essentially what the National Academies report has suggested- we are adding nothing new. The report wants all PhDs in science and technology with 1 year job experience to be allowed automatic AOS benefits (and not just for some future F4 graduates). Again, the report in general talks about all the sciences- specifically highlighting benefits of the life sciences in several pages- and not just the physical sciences. It is for this reason, and if we correctly reference our arguments, that their reasonableness will be obvious to any and every US lawmaker and his/her staff. Had we demanded these based just on our requirements or wishes, it would have had virtually zero chance of getting through. For exact references to the National Academies report, look up the attached letter in the thread linked above.

    dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.

    I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.

    ... Was your MS Certification in your country of birth or in USA? And if it is not in uSA did you get it evaluated in USA and have submitted evaluation cert copy along with your application?

    all that stuff comes in at I-140 stage. During PERM/LC they dont care about his qualifications, its the job that is being certified.

    See the audit questions again, all relate to justifications that the requirements are really needed for the job advertised. ie. when the job ad said MS+2 Years is needed, DOL wants to know why this job requires MS+2 Years of experience. His lawyer is right, a more conservative approach to job requirements (MS+0 or BS+5 for EB2 is much more easier to defend). As you increase the minimum job requirements, it reduces the pool of available candidates who can apply for the job. DOL wants to make sure the minimum requirements are really valid, and not set artificially high simply to reduce the pool of candidates.

    Basically your LC sponsor needs to be able to justify all requirements posted for the job (education, experience, specific skills) else you can be in trouble.

    Yes i called the original civil surgeon and the tb test is going to cost $15 only and xray $40.

    I found the reason i got the rfe.
    I had a copy of the last tb test report.
    That civil surgeon forgot to check mark the tb test !!!!
    He checked a different section !!!

    I feel bad that i missed to read it!
    I could have rectified the darn doctor then and there.

    It was during the july fiasco. We were all in a hurry and tensed up.

    Thanks for your update.
    Once this rfe is cleared, i am going to sue that doctor for expenses!

    I feel sad that people dont do their jobs properly in this advanced country.

    I am little confused here, do they take into account the reciept date or Notice Date ?.


    My Application was sent on July 2, and ack on July2, however the application got transferred to Nebrska, CA and back to Nebraska, and I am told the Notice Date is Aug 30. (If I go to Online website it says On Aug 30 we recd your appln like that) But I am July 2 filer.

    So if I want to move, should I think i am safe after 180 days which is jan 3 or is it March ?

    It's the received date as specified in the receipt (i.e. jan 3).

    1) Sep 16 2007 to Apr 2008 is > 6months so you cannot apply for 797
    renewal to get a new i94 indirectly.
    2) Currently your status is H1 , if you use AP then ur status will becom Parolee and if you use EAD then "???"

    I think of these solutions...
    1) Exit and Enter the country to match with your 797 dates.
    or
    2) Talk to your employer ,find a temporary employer to switch your h1 and switch back to your current employer. ( do premium if necessary ).

    I have a Ph.D and 2 M.Sc in Aerospace and Mechanical Engineering. I got my H1-B and I also have been employed for 3 months now. My company policy required 3 years before sponsoring me. I do not want to wait that long to start applying. How can I tell if I am qualified for EB-2 with National interest waiver? Is that the only way for me to get GC?

    I also want to mention that I have 5 proceedings papers but not journals. I also do not have any citations for my proceedings papers.

    Please advice me what is the best senario for me and if I have any chance to apply for EB-2 with NIV.

    NIW is tricky. As you have PhD, you can apply yourself (w/o sponser) in EB1 Researcher catagory, if you do that kind of job.

    Can anyone please help me with the EFile of EAD. I am applying for my first renewal.

    1. Question: Have u ever applied for EAD? if Yes, Date for application:
    Which date should we fill in here. Should it be First EAD Received Date or Notice Date or approved Date?

    2. While Efiling we have a field (With dropdowns) Current Immigration status(Visitor, Student etc..) which drop down value should we fill if we are on 485 Pending (AOS) as my H1B expired already?

    3. If you pick C9 for Eligibility Status Question, we have a Text box for the question, please provide information concerning your eligibility status.. what should we fill in this box?

    4. At the end of Efiling, does it provide us with any supporting documents that needs to be mailed? or Do you know which one to send? As per the Paper based document instrcutions we should send, 485 copy + EAD Copy. No photos as per the Efiling instructions and should send the EFiled receipt notice..

    I would appreciate if anyone can help me with this info.

    per my lawyer you can come back from EAD to H1 by filing a new H1 petition (if its past 6 years on H1, then you need some basis like approved I-140 or old LC). You will need to leave the US and return to activate the H1. So thats always an option if you jump to EAD.

    In your case, you can still file a H1 transfer, if it comes without an I-94 attached (meaning H1 got transferred, but status was not activated which typically happens when last H1 status ended more than a couple of weeks ago like in your case) all you need to do is leave the US and return some PoE where you will get hte new I-94

    You cannot come back on H1 once you cross 6 years and you have switched to EAD. For you to get H1 extensions beyond 6 years based on pending GC , you should already be in H status. If you are not in H status (e.g. EAD or some other status) then you cannot get H without being outside for 1 year and being counted in quota again.
