    It makes me so mad regular insurance doesn't cover the immigration physical. It's almost like any other physical, in fact it's not even as detailed as that-the uscis site mentions "disrobing":rolleyes: I had to do no such thing.

    I think it's a way to manage your own expectations - if EBn works out in a reasonable amount of time (varies from person to person), the US is a great place to be, otherwise, your own country is not all that bad. :D

    I received IRS tax audit check for year 2005 last week. I guess mostly I can defend my audit and I have scheduled an appointment with IRS tax manager for next week

    However god forbid if I have to pay penalty on audit,I was wondering this would impact anything on my 485 process. Does it have any impact

    Appreciate your thoughts.

    I am 19 yrs old and on H4 visa since Sept 2002. Will this act be of any help for students on H4 who will get be aging out shortly at 21 yrs.
    Your valuable input will be of great help. Please share your views.
    Or is the act only for students of Illegal parents.

    My son and you are in the same boat. He came here 9 years ago went to middle/high school here. Now, he is in college and will turn 21. He will not get his greencard because he is here on H4 legally.

    Thank you for your information.I hope you know the situation right now in USA.In jan 2010 H1 people came to Newark Airport were asked to form in a separate queue as soon as they get down from the flight for two levels of interview.Some of them are sent back.Now you can't find employer to transfer your H1 immediately.Before two years it was possible to transfer H1 with out having recent pay stubs and they never asked client letter.Now if you don't have a job you can't transfer your H1 to anybody.
    Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

    Also, please contribute to IV. I just did today, and believe me, you will feel better for doing so...

    This is not just for you and me, but also for those who will come after us. Also, this is not a battle just to sue USCIS/DOS, but a war we need to fight on multiple fronts:
    1) First and foremost, we the immigrant community need to join hands and fight as one cohesive group.
    2) Sue the government agencies for damages/violation of law/precedents due to the revised visa bulletin
    3) Get this matter the attention it deserves in the media
    4) Try and get congress to intervene in this matter, and also introduce and pass legislation that will fix the broken employment based immigration system
    5) Request corporate sponsorship. Since employers spent money on this fiasco as well, they will have a vested interest in pursuing this as well.

    The main thing, however, is funds. IV needs funds to fight for us. Each of us has already spent 100's (many even 1000's) of $ trying to get ready to file our I-485's. So even if 10,000 members contribute just $100 each, it will be $1 mil. I am sure each of us can at least spare that much. It is a small price to pay for liberation from this GC mess for all of us....

    With ~15,000 members already, and hopefully some serious $$$$$$ raised, IV will be a force to be reckoned with. No one will be able to treat us with such utter disdain ever again...

    Well, first it was Consulting Vs Permanent, then EB2 V EB3 --> This was getting ugly when EB2 was moving fast, before the sudden pause and then USCIS announced no more movement or less than 2 week movement for every VB, and not "A Quota for US Master's or Higher" --> Well they are too many Ph.D's still waiting in line @ EB2-- not all qualify for EB1.. so chances are slim.. if you are from a retro county...

    Only solution for this mess, that got created due to slow processing, erroneous VB on July '07, though helped many here with EAD, Labor substitution that used to exists, different processing center, RIR / non-RIR, different order for spill over from previous years and all ..is RECAPTURE of unused Visa and regulating the future process so new applicants does not have to go through the same mess we are going through..

    Not sure.. We have been talking about RECAPTURE for many years now, but none happened until now... though we have tried again and again... may be very soon we can get out voice heard..

    You can post any number of ideas in forum's.. but it is all easy said than done.. Think we need more focus and try hard to get one issue addressed at a time. A quota for Master's will not get you much ahead in the queue as there are too many "Master's" already waiting in the queue.. It is just my opinion.

    They should realize and should feel shameful for what they have done. It is sheer abuse of power and treating the immigrants without respect. I would even call this as HUMAN RIGHTS VIOLATION as this country preaches other country on how to treat the fellow humans.

    I have two 797s: one which is current valid till June 2007 and the other from July '07 till July '10 (using my approved I140). I am going for visa stamping this March at Chennai consulate. Can they combine both my 797s and stamp me till 2010 or they'll do it only till June 2007?

    I guy at the CBP office said that since my passport will be expiring on July 2007, i should have gotten my I94 stamped only till July 2007 instead of till September 2007 which is whenmy visa stamp will expire ... I am planning to try my luck again once i get my new passport ...

    Another helpful "negative feedback" is the trend of GC applicants stuck in the system moving out of the US. Understandably, most immigrant are reluctant to take this tough step but the trend is here and it grows like a snowball.


    Excellent point!

    Maybe the IV team, when interacting with legislators, can also highlight cases of exceptional persons who got tired of waiting for their green card and are now productively employed in their home country. That will be a nice complement to the stories of people like us who have still not given up.

    Administrative Fix-IT campaign


    No. It's not a typo. USCIS indeed needs to help us in order to help itself. With the recent campaign by Immigration Voice to request the administration to pass certain measures that would immensely help the High Skilled Legal Immigrant community, USCIS can legitimately and administrative improve its processes, so that it can go back and do what it does the best - Adjudicate immigration applications.

    Despite the reality of a huge economic deficit to be borne by the new administration, the Inspector General recently cautioned Congress about the impending backlogs caused by outdated policies and the slow pace of IT modernization of USCIS. One statement in particular stands out - USCIS has come out with plans to modernize its processes, but these plans are pending approval.


    Quote : Until USCIS improves IT management and operations, the USCIS will not be in a position to either effectively manage existing workloads or handle the potentially dramatic increase in immigration benefits processing workloads that could result from proposed immigration reform legislation - Oh Law Firm


    The current administration should pass these administrative fixes in order to better the main purpose of USCIS.

    Some of the fixes include -

    1. Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.

    Due to processing delays, USCIS is forced to waste approx. 20,000 visas allocated for the Employment Based Permanent Residency process. This measure will indeed help USCIS to process and clear the backlog once and for all.

    2. Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.

    By strictly defining job categories, legal immigrants are subjected to undue hardship and career stagnation. When a legal immigrant decides to move to another job with a different (and usually better) position, he/she is forced to start the legal immigration application cycle again, causing more paperwork and process cycles on USCIS's part. One way of Simplifying the process is to relax or broaden the definition of "same or similar" job description while applying for a visa during a job change. Imagine stuck in the same job for 6-10 years because federally mandated visa numbers are not available but you have been successfully approved to get one.

    3. Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.

    Form I-485 is the last step of the Permanent Residency process. This step is required in order for a legal immigrant's status to be adjusted to that of a Permanent Resident. Without this step, applicants cannot apply for I-485 and have to wait until visa numbers are available.

    4. Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.

    EAD or Employment Authorization Document is a temporary status allowing the applicant to work for any employer until the immigrant's 485 application is adjudicated. AP or Advanced Parole allows a applicant who is waiting for his/her I-485 to be adjudicated, to travel to his/her home country in the event of an emergency. Both these documents are available for a hefty sum and are valid only for 1 year. With recent backlog estimates at 800,000 applications, USCIS has to endure tremendous workload by renewing these documents once a year. By issuing documents valid for 3 years, this burden can help USCIS focus better on other adjudication work.

    5. Allow visa revalidation in the United States.

    Visa revalidation, per the State department, is required to be done outside the US at a consular post in an immigrant's home country. This causes undue burden on the legal immigrant.

    6. Reinstate premium processing of Immigrant Petitions.

    For those employers looking for a quick adjudication to an immigrant employee's petition to work, premium processing has been a god send. Premium processing forces the employer to pay more in order to receive an expedited decision on the petition. Premium processing was suspended due to receipting backlogs after the July 2007 Visa Bulletin fiasco. Now that the receipting backlogs are over, USCIS should now reinstate premium processing for immigrant petitions.


    In-house cleanup of the USCIS by embracing the above administrative fixes will immensely help USCIS realign its purpose of adjudicating visa and permanent residency petitions rather spend a good portion of its time working on supporting "pending state" measures.

    I sincerely request everyone to write to the President.

    Same here switched jobs in April with approved 140 in EB3 and hoping to get in the EB2 line with earlier priority date and now have nothing with EB2 PERM in audit. Hope to keep the priority date atleast.....
