    Guys,

    We saw the September bulletin..
    We knew what to expect..
    But we were all a little hopeful to see some miracle happen.
    And we were doing this every month.

    NOW comes the count down we all were waiting for the last few months. Oct bulletin. In that, most of us are expecting some good news.. But what if it moves 3 months forward.. What if it moves 2 years forward. Then it will stop there for next 1 year, while we check every month.. Then it moves back.. Do we want this..
    Its not going to make much difference to most of us here.
    THIS IS THE TIME TO ACT NOW. We must all do some campaign may be flowers, may be cards, or I donno.
    I have written today to all the six members or reps to help us, but a bunch of mails will not help. JUst imagine if all the people in waiting sent the letters. Imagine 100,000 mails going to each of them, or 100,000 flower bouquets going to all.
    Please please, lets act now. These small fixes cannot help us. If they want to put any quota limit, that should be at the main entry level whatever the non-immigrant category. Not at the other point when people start applying for GCs and suffocate here. We dont deserve this.
    Please Lets act now., ONce again.. We did it in the past and it helped..
    We need to do it again... Together we can do it. Together ONLY we can do it..

    EB2 guys and others who got approved: . Please dont forget what you went thru. Please put more efforts and help all in case you can .

    I was the guy from Sweden. I agree with the Russian student.
    The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.

    I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!

    I was glad I showed up at the rally just to hear all the peoples' stories.
    Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...
    You are in trouble until you get your green card in your hand.

    Thanks. One question, I may not have asked it properly:

    What I had (mis-) understood till date was: there were 2 ways for employment based GC: 1) if I was outside US all along, and the employer applied my employment based GC for future employment, and 2) if I was working in US for the employer and he applied for my EB2 GC based on the job that I was offered and was working on.

    Both are for future employment.
    1) means immigrant visa at consulate abroad (consular processing)
    2) choice of immigrant visa at consulate abroad OR I-485 application to adjust status

    It is possible to switch from I-485 to immigrant visa abroad by filing I-824 with NVC.

    Well here is what I have thought of doing if I get into your shoes when I140, US GC looks dicey. (I already have Canadian PR till August 2010).

    I would take a three/four week vacation and go and live there. Prepare for a job and get first hand ground feeling of what it feels like living in Canada, make a living and raise a family. After all making a living to able to support yourself is a important corner stone thing. You can't live of fresh air.

    Can you compare your situation ? No. You are not the same nature, skills, personality, intelligence and willingness as others and most of all your own Luck. You know yourself best and the only way you can tell that the place will work out for you is when you go get a sample for yourself and your gut feeling. I went to Vancouver and just loved the place. My wife saw the clouds and gloom and hates the place (spoilt by southern california). You will be your best judge.

    Take the harshest sample: Winter is tough in Canada. Go now and take a feel of what you will be expecting and set your expectation.

    Info: Approx 90% of the Canadian population lives within 100-200 miles north of the US border.

    Down the road: Make a plan and see whats your options down the road. Looking back is no good way of planning for the future. 3 years + few months, you can be Canadian Citizen. You have then the option of using TN and come right back into the USA, if you even have the need. Looking back now I feel I should have started this journey 2 years back. In the next year or so I would be a Canadian and could have come right back without the 140 and 485 headache. After two years I am still holding my breath for 140. Rightfully, Heaven is where I feel at peace. US has made me feel miserable and bitter after 9 years of rough rollercoaster and no end in sight. Can't buy a house, can't live freely, always on the edge and mercy of the Boss and H1B.

    Having Canadian PR in hand is like having a bird in your Hand, and US GC is like two birds in the bush (I feel the birds are in Bush in Texas :) and its going to eat me, rather than I eating it) You don't even have the US Bird in sight and the story is getting tougher....

    All options good. Go spend some time in Canada and see what your gut feel says.

    Theoretically yes; because for a 485 to be pending for more then one year; then the labor has to be older then one year and/or the 140 is older then one year.

    I think the situation that you may be talking about is where 140 has been revoked but 485 has been pending for more then one year. The law only talks about 140 and labor older then one year. If one tried to do it this way and uscis should question you then there is no legal basis of doing it.

    That being said; I do know of a case where a person did get an extension even though the 140 had been revoked. Had to be a fluke and I wouldn't say that it is the norm; because there is no legal basis for it.

    Hi Learning01,

    I did not want to "steal" your idea about publicity of the problem back in our countries. I just developed and enhanced the idea :-)

    And I do not think we should be ashamed of the fact that this great country screwed us and made more than half a million highly educated and trained people (spouses included) chasing for a decade a mirage called GC and looking like idiots.

    For example, I came here on L1 visa (intra-company transfer) in the beginning of 2000 - very big international company with big presentation in the States. The initial information I had from colleagues and management was that permanent residence can be taken in certain reasonable period, providing that you worth it. I did my part of the deal, my company management also did their part but the US government changed the rules of the game and I got screwed.

    Shall I be ashamed because the US government does his best to kick me and another half a million like me out of the country? Definitely not, that is not my fault! Neither should be the rest of of the legal immigrants caught in the mud created by US agencies. Our applications gather dust in DOL offices without reply for years and we should be ashamed of that ?! One of the ways we can pay back for this "favor" is to tell the thrue story to the world - honesly and openly.

    In fact I believe that the US government should feel ashamed of the mess they created.

    The second bill (HR 5634) says that people with PhD from US universities are cap-exempt from EB. So it means some quota will be freed up from EB1 and also from Eb2-NIW.

    Read all the bills. I guess you are bummer !!!!

    try calling now..most dr's that were packed earlier this month are now wide open due to everyone cancelling. but do it fast with the new developments things might get tight again. for eg- I have an appt lined up for Wed morning just incase things come through tomorrow :-)

    I signed contract on my house and now looking for a mortgage. I�m looking at eLoan, LendingTree, credit union and a few banks/lenders listed in Bankrate.com.
    I would appreciate if you can share any information regarding any of the lenders, your experience dealing with them or any other useful information which will help me make a informed decision.

    Bank of America has a great program called No-Fee Mortgage Plus (http://http://www.bankofamerica.com/loansandhomes/index.cfm?template=lc_mortgage). It does not charge some of the fees - like the appraisal fees, etc + reasonable, competitive rates. They also guarantee to get all of the closing done within a certain period of time, which they usually beat by at least a couple of days! We have our mortgage with them presently. There is also Sallie Mae Home Loans (http://https://www.smhl.com/index.html)! We had our first home loan with them, but then they sold it to AmTrust Bank (http://https://www.amtrust.com/Personal/Pages/home.aspx) formerly known as Ohio Savings Bank. Our rates or anything else did not change. We live in AZ.

    You should window-shop around as much as you can, but remember to initiate all of your inquiries within a 2-week period - so it is counted as a single hit on your credit history!

    Discussing all aspects of mortgage - there is an excellent resource, The Mortgage Professor (http://http://www.mtgprofessor.com/) ! As immigrants, we have to share all info we can, the kind of info that is usually shared between family/ friends if you stay where you were born!

    Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.

    In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.

    As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).

    Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)

    And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.

    *** Also, to the previous poster (nojoke) who said that big companies usually hold off on perms, are you suggesting that I have a better chance at a smaller company then?

    UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.

    I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

    I will be calling today in the morning and have told several of my friends to do the same. whenever I get a chance at parties or get togethers I tell people about IV and I was surprised that 80% of people (who are stuck in this mess) have not heard about IV. so I would urge everyone to mention IV whenever they meet anyone who is in a similar mess ..especially inform batchmates and new friends and ask them to atleast register

    My experiences have been similar. Not many immigrants I meet at social / cultural venues know about IV. I would urge every member here to actively spread the word of IV and membership at every possible and appropriate occasion you get in a face to face manner at your regional / national cultural associations / festivals / functions / events / summer picnics etc.
    And more important is to call as per action items, so please take a few minutes from work to call.

    thanks for your understanding and taking it in the right spirit. I myself had an RFE and responded. Please share your RFE when it reaches your hand and let us know the details and I am sure you will get excellent inputs from all the great souls in IV.

    If the recession does hit,

    will the visa bulletin of every month jump faster?

    or will it slow down?

    does anyone know?

    In general it should not affect the visa bulletin because even if people lose jobs they can potentially scramble and get something soon enough (esp if they are on EAD). A future job offer is enough to maintain status atleast.
    So for all the people already in the queue, its possible to stay in the queue even if the economy tanks.

    For people not yet in the queue, even if they are forced to return to their home countries, they dont impact the existing queue.

    Press coverage in India is an excellent idea. I think this bloody american press is biased. We should all write to Indian press and highlight our issues in strong words. If we can get 100+ letters to TimesofIndia, HT, IE , NDTV, Deccan, Hindu, etc, we can highlight the discrimination and indentured servitude to the young Indian generation who has high hopes for USA. If 100+ H2B workers can stage dharna in front of an embassy/white house why cant issues of Indian people get highlighted? Lets us show the job here in the same light as slavery in middle east. I am sure David Mulford will be ringing a few phones after that.
