    hi pd_recapturing/gene 77,

    Is there any update on your case, I have similar situation,

    I have applied my I485 with priority date of Jan2006 (my I 14O is approved).Mean time the same company
    applied a sublabor with a priority date july10,2001 for Eb3 ,which is current. Can i replace my old i140 with
    the new i 140(eb3). and if i success fully do so, do I have still have to be with same employer for another 180 days.

    When I called USCIS today they said some officer is reviewing my case, does this mean interfiling is automatic?

    My PD is current for 2001 july10 eb3 category?

    Please let me know...

    I saw this on an anti immigrant site by a M*****r.

    Hope some of you will learn a lesson from it and stop posting threads about Telgus, Eb3 vs Eb2.

    I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.

    They are right to be worried. The L-1 has more restrictions on it than the H-1B, because of a crackdown about 5-6 years ago (if memory serves). They were interpreting ANY IT skill as 'specialized knowledge' that would justify bringing in their folks, then shopping them out to displace ours. Even that notorious traitor, Harris Miller (former head of ITAA) warned them to cut it out, but Hindu hubris prevailed. Until the crackdown. There are two types of L-1 visa, one for managers and one for subject specialists.

    One interesting thing: over on Immigration Voice and on any board that allows posts, as soon as we start nailing the problems of the H-1B visa, they start whining, 'what about the L-1' and 'what about the illegals from Mexico' (as in, go worry about them and leave us alone). When the seat gets really hot for them, then the internal ethnic and caste hostilities often start to show. 'It's those gultis' (Andhra Pradeshis), 'It's those gujjus' (Gujaratis), 'It's those greedy Banias' (large merchant class), 'It's the northerners (or southerners)' and so on and so forth.

    Another interesting thing: In all the years that I've been watching Immigrationvoice.org, I've seen many situations where an H-1B has fallen out of status. Firing, layoff, botched job switch, etc. In only ONE case have I seen the advice be, "pack your bags." There are a million loopholes that Americans might be outraged to learn about. 8-9 years ago, the average American had no clue about guestworkers visas, but now they know something has gone very wrong in the job market.

    My wife was on maternity leave last year. She was paid partially by the State and partially by a 3rd party insurance company. Her employer did not pay for these, so they did not include it on her W2.

    I am not sure if your case is similar, but this is what I know about maternity leave benefits. BTW I am in CA, so I am not sure how it works for other states.

    AFAIK, Short term disability payments are not taxed by Fed and State. We got a W-2 from the 3rd party ins company. This W2 only mentions the payments as "Third-party sick pay" and does not add to the gross W2 wages. My wife also took the CA paid family leave which is paid by the State. We got a 1099-G from the state for this. AFAIK, the paid family leave payments are taxable by Fed but not by CA state. BTW, fathers are also eligible for this paid family leave in CA within the 1st birthday of the baby.

    Guys,

    The reality is that we are just being played upon by the companies and the US govt regarding green cards. Employers know that we are not going to budge from our jobs to maintain the coveted priority date and the government is in no big hurry to reform the system as they can collect taxes from us without being accountable to us.

    I think Democrats are also going to drag the immigration issue as seen by the article below :

    I do not mean to doubt IV, but the writing is on the wall that our lobbying efforts are not going to go too far.

    For all of you single people out there, the only fastest option is to marry a US girl/guy. For all those who are married, the choices are simple, forget the American dream and adopt a Canadian or Australian dream or endure the uncertainty of a green card application.

    I have reached the conclusion that I cannot bear this uncertainty any more and therefore, I am pursuing other options. Ciao...Good luck to all those waiting for a GC!

    Probably a dumb question which was answered before in some other thread.. but just so that I understand better:

    Am I correct, or totally off base to say: There are no clear cut legislative guidelines regarding how cascaded visas or recaptured visas are to be used especially w.r.t country limits. USCIS has the discretion in how these visas are to be handed out..
    If so, how has USCIS handed out these visas historically?

    It's a bit more complicated than that:

    Law comes from three sources:

    Comman Law: Laws inherited from the british justice system (evolved over centuries).

    Legislative Law: Laws passed by congress and signed by the Prez.

    Regulatory Law: Regulations created by the regulatory agencies to implement the laws made by congress. Congres doesn't always finalize all the details to the last comma and leaves that work the relevant government agency. For example, FCC, SEC create regulations about how the congress' laws are to implemented. These regulations have to conform the laws passed by congress. These regulations have the force of law.

    So when congress did not stipulate any specific overflow mechanism, it left it completely up to USCIS to work that out.

    Historically EB2-RoW overflowed to EB2-India and EB3-Row overflowed to EB3-India. Soon after EB3-RoW was retrogressed, USCIS channelled EB2-RoW to EB3-RoW. This is expected to continue till EB3-RoW becomes current itself.

    Therefore, if you're looking for any progress in PD, whether EB2 or EB3, the key parameter you should be watching is EB3-RoW cut-off. Only when this becomes current, others can even _think_ of nirvana. Without overflow of RoW's, both EB2-India and EB3-India cannot progress more than a day in every bulletin (at a average). EB3-Row moved a month and a half in Jan bulletin, which counts as a progress, however small, for everyone. That holds true -though not easy to intuit- for EB2-India as well!

    You have to create an online account to get updates on you application. You will see LUD and there is the date everybody is looking for. You can also receive email if take the option.
    You will not see LUD if you just put in your recipt number to check status of the case.
