    Very good point logiclife. what happens in this following scenario when 140 is approved and when 140 is pending.

    Person X has completed 180 days after 485 filing, used is 6 yrs of H1 and now he got a 3 yrs of H1B from the same employer. If this person uses AC21 & EAD and joins another company and after 1 yr his 485 is rejected for wrong reasons, will this person be out of status(since used EAD) or will be in status since his H1b is still valid with the old employer (Assumed the employer has not revoked). Will it be safe to come back to the same employer.

    I dont think that after using H1 for 6 years, you can switch to H1 status from EAD status once 485 is rejected. Now, if you have used less than 6 years of H1, and then used AC21 portability, used EAD, abandoned H1 status and continued on EAD status and if the 485 gets rejected, there may be a way to reclaim the remaining unused portion of H1. It may involve going out of country and coming back in. Check with a lawyer, I dont know much and haven seen any case where someone who was on EAD status could go back to H1 status. Usually H1 to EAD is a one-way street, especially if you have already used up the 6 years of H1 stay in country.

    So that the point is not lost, the two Senators should not seek to blame certain companies from only one country for the ills of outsourcing as well as attempt to blame the H1-B program for outsourcing when globalization is the order and reality of today's world. The fact that companies such as Accenture that specialize in outsourcing are not under similar scrutiny by the same Senators even when it is common knowledge their actions have resulted in the loss of US jobs raises serious questions about the Senators agenda in tackling outsourcing and in retaining US jobs in the US

    You would need employee letter as well. The employee letter will state that the position is still open and they are willing the pay the amount that was initially agreed to while filing for labor.....so pay stub is not enough.....

    My lawyer as well as my wife's lawyer confirmed that an employment letter is not required if using pay stubs. Several posters on this forum have gotten the same information from their lawyers. Anyway, let's not get into a debate on who's correct or incorrect.

    It's a different thing to have the employment letter to make the case stronger (probably), but you will definitely not get a RFE for using the pay stubs. And in "sats123"'s case, this is a less expensive and reliable option.

    Of course, one could argue it's worth paying $5000 if it ensures a smooth adjucation, but then that would depend on the financial situation of the applicant. I cannot comment on that for "sats123".

    Having written all this, please check with your own lawyers and do what they advise.

    You see, not all the folks that receive gc are able to utilize the benefits.
    I have ton of friends who received their GC two years ago, and now they keep telling everyone that it is no different than being on H1.
    All I tell them is I will trade my H1 with their GC, and all they do is Shut up.
    Yah, sure, if USA allowed us and our better halves to work unlimited without any doubts of going back abruptly one day, then I would rather stay on H1.
    But as we all know, that is not the case.
    I have finances and places set up to start business. The only thing holding me back is this damn backlog. My wife has a masters in communications and held a better job than me in India. What is she doing now? Watching my newborn kid play, and offer volunteer services to local hospital.
    I am damn sure GC could solve that.
    If some people are not able to take benefits of GC, doesnt mean that they should assume the same thing with others.
    Things are different with everyone.

    Sure, why not. An immigrant who is not in valid status is one who is legally not allowed to be in the country. Therefore he is a security threat. If somebody who should not be allowed in your house were in your house, you would consider him to be a security threat, wouldn't you? Am I missing something here?

    Yes you are. That was just a blanket statement. I need some logical reasoning from your side.

    "somebody who should not be allowed in your house" is not necessarily a security threat.

    The fact that "somebody is allowed to be in the house" doesn't mean that he is a safe person to be around.

    The condition "whether one is allowed/not allowed to be in the house" does not have a direct relation to the security aspect.

    The kids from the second marriage can definitely come. He can call the first wife get her the green card, then divorce her and go and marry the second wife and bring her here.

    once he gets his GC (until he becomes a citizen) getting the 2nd wife over iis going to take too long, as its in FB quota, not EB. Thats one reason why many unmarried folks did not file their I-485 in July/August. If their 485 is approved before their marriage, then bringing the spouse over is real tough.

    I will be sending the following note to my senator and have already posted it to WhiteHouse.gov. I urge all those screwed by the ongoing retrogression to do the same.

    "I am writing to inform you of how the country based quotas imposed on Employment Based green cards are unfair and totally illogical. When I immigrated to the US, I believed that this country was a meritocracy where you were judged based on your abilities and qualities. These country based quotas reward people depending on where they or their ancestors were born. This causes people from India and China to wait over a decade to get a green card whereas someone from another country with similar or lesser abilities can obtain permanent residence in half that time.

    Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this discriminatory policy and reinforce that America is truly a society that celebrates meritocracy."

    If you have a company's blank letter head and genuine salary slips then every thing goes...
    I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.

    Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!

    ramus, follow my posts in the past 20 days and you will see i have posted many posts for this AP expedite. I have a travel coming up shortly and I had only exactly 90 days from the date of application and date of travel. My application was approved recently along with my spouse. There is even a post where I listed out all the steps I took to expedite and finally finally only the local congressman phone to USCIS helped. its just unbelievable, but its possible. I have tickets that even if you postpone the journey I will lose money. I said to myself enough we lose with USCIS, and so decided to take all and any steps to expedite and get it done. just follow my posts (like start reading my past 20 posts) and I am sure you will find it useful.     Financially, most economoists are predicting that east bay market is bound to fall further. (I would not discount the opinion of CNN Money easily).

    That having been said, I agree that living in a house is definitely more about feeling than about finances.

    How does someone know when is the right time to buy a home? Anytime is a good time to buy a home, as long as you can afford it. I thought the last few months were good time for buyers because of the inventory situation (more choices or otherwise you bid usually in CA) - I dont think anyone can predict the market situation in 5 years and no one makes money in 2 years in a good market condition as well. I bought it 2 months ago in East bay and I am planning to hold it for another five years atleast and both spouse and I work - it is certainly not an investment for us, rather a place that we live - it is a rare feeling one gets after living in exile (apartments)
