I similarly applied online on Dec 20th and haven't heard anything at all. I applied online and the documents were sent to the Neb office. Can you please share your details on I765 extension filing?
well, honestly speaking, it wasn't an extension. i am still on h1b, however it expires soon, so, i filed at texas service center, taking the 120 day period as the processing period.
what i mean by not an extension is that, i once applied for 765 when i filed by 485 during july 2007 fiasco, but later, i never bothered to renew it.
hope this helps,
Jai Hind

I have a question on this:
I understand that USCIS can raise an RFE anytime even if PD is not current. However, lets say if they raise an RFE for EVL today, and the person is working in same/similar position and replies to the RFE.
Would that mean that USCIS will not raise an RFE again on EVL? What happens if the person changes the job an year after that?

That's pretty much what my lawyer told me.
Okay. I was able to talk to my attorney just a few minutes ago. He said, to do interfiling , you do not need to have PD current based on new I-140 as this is just a case update with new 140 information. He said that in any case, your 485 will be picked based on PD. I found him very very confident when he was telling me all this info to me.

They won't be any better off here.Instead of being kicked out fair and square, they will be made to decay on H1 visas for 15-20 years. Talk of choosing a rock over a hard place. Besides, the British MPs seem to at least understand what skilled immigration means - here they will have the pleasure of being grouped with meat-packers and grape-pickers who matter-of-factly walked across the border.
I think its also a lesson for those tired of the US immigration system and considering moving to other countries - lets face it, immigrants are not exactly welcome anywhere. Either stick it out, or return to home country.
yes I shared my views with few friends who are moving to US on h1b from UK and advised them that grass is not greener here either. For some reason, a lot of people still do not understand the retrogression issue, anyways, when they come here they will know :)

THIS IS INDIA AND INDIANS
LOOK WHERE OUR MONEY IS GOING????
Top Five
1. India ---- $1,456 billion
2. Russia ---$ 470 billion
3. UK -------$390 billion
4. Ukraine - $100 billion
5. China -----$ 96 billion
Shame on the Indians who hoard all that public money in some foreign land and making those countries rich. When would the stupid @#$@# @$%#$ politicians and bureaucrats learn that, when they die (and I hope they all die soon) they could not take it with them to Hell.
We have no guts to fight the terrorism coming from across the border and spent too little on defense, education, sanitation and infrastructure and even today India still looks like the same country that was there before 1947. Nothing significantly changed in terms of literacy or cleanliness or standard of living of majority of individuals.
I still have a hope that one day a daring and honest person would hold the PM office and clean up the mess.

gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?
Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

Maintaning F1 status while I-485 pending is not a clearly defined area by USCIS. There are some resources I provided in the following link. There is no definite answer for this.

My personal situation: I was on F1 visa for 6 years before I started LC process with a company for a totally unrelated to my field of studies position (EB3). We had PERM approved and filed I-140, with me still on F1. I-140 was approved and now we are stuck in retrogression. Meanwhile, and after I-140 was approved, I graduated and applied for H1B based on my major. I have disclosed on H1B application that I have I-140 approved from another company and attached a copy. Not a question asked. H1B was approved within 9 days (cap exempt). And there's more. Because I violated my F1 status years ago by accepting unauthorized employment (tracable through taxes), my lawer told me to leave the country and re-enter, to cut the tail clean and be eligable for adjustment of status when the quotas open up. I went to Canada, and applied for H1B visa stamp, disclosing on the applicqation that I have I-140 approved and have violated my visa terms previously ("yes" to question 38, in "kiss of death" section of the application). Very stressful time that was. But in the end - no problem, got the stamp and was back in two days.
Anyway, sorry for the long post. I hope this helps.
Thank you very much for this reply. This is exactly the situation I am facing now. I am feeling a little better. Thanks a lot again.

Is this call GC specific questions related or can we ask OPT/H1/Cap Gap questions also?
You can ask any personal Immigration application related questions. The attorney is qualified to answer any Green card related, F1, H1, L1, Visitor visa, EAD OPT etc and even Family visa questions.

Please don't travel thru countries that impose this ridiculous transit Visa requirement on individuals, especially from India. Ask them to justify the charges, and you would get no response from them.
So, even if takes to spend $200 - 300 more, AVOID these crook countries that charge Transit Visa. People we must send the message across. In this century, I think its Indians that are traveling the most on these trans-atlantic-asia route, and collectively avoiding these 'snob' countries would send a very good signal.
If you are buying the transit visa, your dignity is at stake. Its like saying buying insurance for a person who is poor. They dont charge for countries that are more developed. so, AVOID AVOID these countries.
I am traveling to India soon, and I am going thru Brussels not because I got a cheap ticket, but because there is no transit visa required there.
Can you please share through which airlines, that goes thru brussels ?

Thanks brb2 for picking up on my concern.I was afraid, not a single person would reply. This problem is going to be as bad as the BEC one if nothing gets done about it.Its so unfair and there are soooooooooo many people stuck at that stage with no hope of even knowing their status, until its actually approved or denied.Cant even imagine how frustrating that is going to be.Yet somehow not many seem worried about it.Even though i am not at that stage yet,its painful to see my friends go through it.They have resigned themselves to wait endlessly. If we can fight against the unfairness of the july flip flop,we can surely do something about this.I am sure core group has this in mind but it'll help if all members show the same anxiety!!Maybe we can bring this up along with the SKILL bill.Maybe the FBI needs more funds or manpower, watever it is,let them ask for it and get it,instead of stuffing us all into this bottomless pit!!

How can you say that its not legal? When you sign that contract or piece of paper, it means you are acknowledging to all that is in there. Whether you like it or not, when you sign a paper you essentially are saying, "hay! i read this and I agree, here is my signature"...correct me if I am wrong...
From legal point of view, its 2 parties agreeing to a contract (by signing) however unjustified it may look. Maybe some part of the wording may be legal some may not be...
99% agreements written by the desi consultants are not legal ( they are one sided) . if you dont sign it , you dont get the job.
I am not a lawyer , and this is my personal view out of the experience on being a H1

The voting part is currently over! Please read my earlier post, as some of the vote counts will be adjusted to remove votes from individuals who have the same/very similar IP as another voter for the same entry.
There seems to be a tie for 2nd place with three entries having 8 votes. Therefore, there will be some runoff voting as well.
Should be exciting :P
