Hi Mike. Please don't mistake the spirit of this post. By no means is it a "wish" for Nikon or Canon, or any manufacturer to be "on the ropes". The very simple fact is the D2h does not compare to the Mark II. That is from a shooters perspective. Not only my personal experience, but of other long time Nikon shooters I know who are switching. I also know from personal experience of a major wire service bureau who is not happy with the D2h quality as is switching to Canon. My observations are based on my working experience, and that of other working PJ's that I interact with on a regular basis. I truly hope Nikon's next camera and their cameras after that are killer. That would be best for all.
With 80% of the total professional market I guess not too badly. I believe the D2H is a much newer system than the 1d mk2 and of course it will be almost half the price streetwise, so a lot of part time pros will want to consider this body seriously. I seem to rember the 1D did not do well against the D1H, also with half the res, until the 1d started to match the Nikon price. I guess the same thing will happen, only the D2H does have a killer system this time round. Someone mentioned file tranfers to editors and publishing house and mobile connectivity,I think that's where something like the D2H will probably score. You can do hero worship of your lawyer whoever it is. I will not.
Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.
Ask him if he contribute to IV instead?
Ask him to give you priority instead of your employer who gives him business every year.
Ask him why AILA is not giving you regular updates through him. As clients of lawyers we should get regular updates and prompt responses. What are they doing about country caps removal, end of retrogression, recapture etc. I mean they are so powerful, so why can't they do it for us so that we no longer need lawyers and save a lot of money? Arn't we all spending thousands of $s on immigration attorneys ? and only few of us pay only $25 and many are free members and get such a good service from IV website. We all hate to pay a single dollar to IV and accuse IV core of asking contributions every time there is a drive but IV still helps us. They need to learn from us.
Why none of us has the courage to do it, but we have the courage to trash talk IV and blame its core for not working hard enough for our $25.

gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?
Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

There is no such status as "out of project". Based on the fact that you do not have a job and your employer is not paying you, you are out of status already. It is your employer's responsibility to pay you no matter you have a project or not. In fact, it is because of cases like yours that USCIS has raided those desi body shops and put them behind bars.
My advice to you is change your stauts ASAP to F-1 or if you are married, then to H4.
If the above two options are not something you can do, please leave the country.

Maybe USCIS is already processing the PD 2007 for India, and the VB Bulletin next month will be current for the others. If thats the case they already advanced the cutoff dates.

I did. Same or similar job occupation, but different location. Started off with EAD, then got approval of H1B.. Lawyer didn't send AC21 letter. Already filed for next EAD/AP.

Its not a legal loophole. Some states just do it that way. Their under pinning argument is that you are on a temporary visa and does not have permanent residency. Also, its not the University that makes up the rules. There is some thing called domicile office in most schools and they determine residency for in state/out of state purposes. The domicile office has specific set of instructions on how they should determine eligibility requirements for in state. For example common wealth of VA has state council for higher education (http://www.schev.edu/Students/VAdomicileguidelines.asp?from=students) that provides these guidelines. Check out what AZ has to say and if they say only permanent residency is a requirement to be eligible for in state, there is nothing much you can do.
Also, its not a federal violation as states decide what they want to do with their university systems. If you want you can write to your state senators and assembly man and see what they have to say. Its very difficult to explain them these nuances when there are a bunch of people crying out loud that many illegals are getting in state rates.

Hello,
Yes, as my PD is Feb 2005, this implies that the case has been pre-adjudicated as of now pending new finger prints.
My case was originally at NSC, was then send to MSC (National Benefits Center) and then was sent to local USCIS office in San Francisco where I went for an interview and then had this request for documents. The processing dates for San Francisco field office as of now for I-485 are Aug 1, 2008. So, I'm assuming that they have cleared all the cases that reached them by 31 July 2008 and that NSC sent my case file to them by 31st July 2008.
The IO who interviewed me was different than the one who has worked on my case since.
Yes, thanks for the wishes...but in this process, nothing is certain till the physical receipt of the cards, right? :)
PS: As far as I know, fingerprints and medical records are the two documents that may expire...apart from the applicant! ;)

If you are talking about the discussion. then am referring to the items and not the discussions.Have I missed these items some where that are like the above. Then we are good to go. Can you let me know if the action items already there tries to encompass all thes issues and possible solutions. Someone posted a link describing I-485 Standard Operating Procedures. It is very detailed and interesting to read. It even described color of paperclip to use, place it on left or right corner, how to fold papers, how to form group family cases, how to shelve and label them, etc. It also has a very detailed description on where to click on screen while working on cases. The document is dated year 2001 but may have been revised since. Contents of this doc suggest that cases are first reviewed following some work distribution method, original mailroom RD is used wherever receive date is to be entered (automatically generated RD might be different though). PD is not part of initial data entry. Cases are placed in order of PD ONLY after they have been pre-adjudicated (shelved as 'waiting for visa number availablity'). etc. etc.
There is also a expedite procedure for cases with children between 20 and 21 years, where files are hand transferred from desk to desk.

Some scenarios to consider
1. If 140 is approved and its been 6 months since date of 485 application and your company who sponsored is not revoking 140, then ability to pay might not matter and you don't care since you can use AC21
2. If 140 is approved and it has not been 6 months since 485 application date and you are on good terms with and your employer is not going to revoke your 140 , take an unpaid vacation to fill the 6 months gap if you can, then you are still safe to use AC21.
3. If your 140 is not approved but you have passed the 180 days litmus test and you use AC21 to move to another employer then the ability to pay might come in to picture if any RFE is done by USCIS.
4. If 140 is not approved and you have not passed 180 days its a variation of the 2nd case and if you can pull it off you can use AC21 and work elsewhere later.
there might be other scenarios but consider each of them carefully before making the decision. While it might seem a simple decision having come so far in your journey you don't want to make as wrong decision only to rue it.

When I was hired last spring, I was not told about GC retrogression by my employer. I beleive they should have explained in graphic detail and if they done so I would not have left a good job and my home in Canada to move to an American nightmare.
I recently discovered that I have at least a 5 year wait as an EB-3. My teenage daughter will be too old to get a green card as a dependent and my wife is seriously depressed about not being allowed to work.
How many other people are as P-Oed as I am and is there a class action suit here?
I'm pretty upset too after getting the same nasty surprise. Fortunately I only have about 100 miles to move to return home. I'm surprised that a major corporation like the one that hired me would be so sleazy.

This is one critical thing that USCIS must consider.....USCIS must have another way to handle EAD applicants with H1 or L1 and fast-lane for those without. H1 and L1 applicants (except those expiring soon and no more chance to renew) do not need EAD immediately while those without H1 or L1 needs it immediately.

Just back from a useless infopass. IO flashed 'urgent' memo (dated 8/21) circulated by uscis/dos and said effective 8/21 there is a freeze on AOS EB2i/c so wait till oct. BTW my EAD is expiring on 9/23 and renewal filed on 5/27 according to her is outside processing time (apr08). She said case is at TSC and can only sent e-mail, which may take 3-4 weeks for any response. SO all-in-all-a-waste-of-time.
No explanation for why Aug processing dates not yet out.

The Forums are not secure as they are watched by anti immigrant groups. Key communications like this can only be through state chapters as the membership to the state chapters are secure. Please contact a chapter that is nearest to you. If not PM me your phone number and contact info, I can pass it on to my state chapter (IV Tri-state) and have someone contact you with information.
