ok this is what I have
a) email with offer of employment and link to I9 form in offer letter
b) accepted verbally
c) background check done and report sent to me
d) called and was chatting when I mentioned EAD, was told sorry we cant offer you employment due to EAD, and that is has to EAD filed by this company only because they cant verify its legality et., one way was for them to do my h1b but they are not hiring h1b right now, so sorry. later they said they would consult with legal and get back to me. however i dont hold out much hope
e) i immediately filled out the i9 form
f) wrote email to them outlining our conversation from d) explaining my surprise (and boy! was a surprised!) and trying to make my case that I was not a risky bet for the company because of how interminably long I have been in this country and my spouse had GC already, but mine was not processed in time before priority date became not current.
g) hr wrote back, acknowledging our conversation and saying that they were not sure and that is why they were going to consult with their legal dept and will talk next week.
All I have are emails and offer letter.
I really dont want to go the legal complaining route if this can be resolved. But I am in a fighting mode. I probably would not have been so upset if I had not turned down other interviews...

I got the SLUD on 9/3, 9/4, 9/7 2010. Showing the same message under review.waited all these days hoping for good news.No good news.called c/s(customer service),got response that they only "touched your file on 9/3,but don't have idea what IO did."

I also got my letter and envelope back from TSC. :confused:
I received the same thing. A canned reply asking to use their phone lines for inquiries. They returned my original envelope as well as my letter :rolleyes:

in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!
NOT SURE WHY ?? this delay is ??
i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

Yes, I agree that not filing GC earlier is not an excuse for MBA. The point is he still would have been in the same situation (EB3, 2003 is not too different from EB2, 2005) in terms of how fast he will get his GC.
The law would allow him to port his EB3 PD just like how it is doing now. he will not be in the same situation, isn't this better now?

Vonage does work with a home security system, but they do no recommend using it for that purpose because then your security system is dependent on the internet to make the call out during an emergency.

OK, unless you never initiated the EAD conversation, technically they are supposed to ask ONLY if you are legally authorized to work in the US or you need sponsership.
OTOH I really dont like the idea of having to be quiet and hide my status. Its not something that I should be ashamed of. I have paid my dues dammit and lived here all these years. The immigraton folks should clarify this once and for all, so whoever is waiting for their GCs can think clear and hard if this shit worth it.
After spending half my life working for this, they turn around and say its not valid for employment ? not fair.
I was gungho with my EAD, very pleased that I could work for whoever. Seriously, I think sometimes that its better to go back. Its not like this great country is making it easy for people to contribute their skills.

OK, DOS buffer issue.
A. LAW. If there is no inventory in EB2 I/C (meaning demand). Theoretically DOS should make EB2 I/C CURRENT. DOS/CIS are not that dumb, or at least as dumb as before. I would say, they are very competent now and we should appreciate their work, pre-adjudicate, publish demand data (DOS), inventory data (CIS) processing time (DOS). THEY know, from PERM, I-140, there are at least 2K demand permonth from EB2 I/C. SO they will just safely move a couple of month of PD to make sure there is demand >2800 for India/China, so they don't have to make it CURRENT (per law)
B. LOGISTICS. There could be denials, RFEs, although most (I believe almost all 100% pre-07/2007 EB2 I/C) should be pre-adjudicated now (THANK DOS CIS specifically did this so no processing time, and no waster numbers hopefully). That is why DOS has to consider that in their demand, and CIS has to consider that in inventory numbers
C TIMING. Charles is shooting a moving target as well (his job is not easy as he cannot predicate future 100% and has to follow law, and use all visa numbers, we should appreciate that). Charles has no control on CIS number accuracy (I am sure CIS is trying hard as well), how fast EB1/EB2ROW/EB2I-c pre-072007 could come in, hey even some CIS employees need vacation in summer. So he has to make sure things can be done before August, so August could be only a month for fine tuning, not massive approvals, new applications (CIS wont look at them any way but takes man power), to use up all numbers and have some new applicants to keep the inventory (demand) at decent level.
I am July 2007 PD, and we all have hopes, dreams, life, etc, can can distort our judgement. We can discuss, but may to suppoert each other, and those warriors in DC. Sorry, I did not see the Fedex part of your question, but here is what I have found from experience:
I had to send some tax related documents to the IRS earlier this year. And I went to UPS. They said that they themselves do not deliver to P.O. Boxes, but take the help of the USPS to get the job done.
So, I went to the post office, sent it via the one where they give you a tracking number, and it worked out fine, and cheaper. I intend to do the same this time.
Regarding the arrangement of documents in the packet, I would refer you to:

I have decided to use AP and have cancelled my appt in Chennai.
I have an appointment at Kolkata on the 11th. Scheduled to fly back to US on the 26th. Considering Martin Luther king Jr day it will be 9 working days. After seeing the PIMS delays, I am seriously considering return back on AP. Cannot take the risk of delaying the flight as I dont have vacations to hang around and wait for PP.

hello all,
i will really really appreciate your posts..
its been 23rd day..H1B renewal..New Delhi..still waiting for PP..i got no slip ..no warning to wait ..nothing..
But now i think its not stuck due to PIMS..it could be anything ?? some admin processing ? some security check ? some name check ??
How do we differentiate what are our passports held up for..COULD THIS BE CALLED 221(g)..i read in forums..221g can take forever ??

I am not very sure but my understanding is that consulate will tell you if there is any issue reg security clearance etc (in other words 221 g).
Did VO tell you anything about administrative processing during your interview??
