AC21 cannot be used before 180 days. Also the employer may be upset if you take a vacation and do not return. Why not give two-week notice and quit normally? Plus, the new job is contract to hire. To use AC21, the new employment offer has to be permanent, IMHO. Programmer analyst to DBA may not be a big issue. You have to try to make sure your previous employer will not withdraw I-140.

Different jobs have different requiremends Hi_Nu, for example, a website for a local golf course has different requirements than a huge corporate e-commerce site. I definitely don't know all of those things that you listed "by heart," but I have produced a few quality websites for clients (I am 15). Voets is right, the clients don't usually care how old you are. My clients are always really cool about it and astonished that I am so young and know so much.

Well - these people get VIP treatment in prison - believe me - they get good food, drinks, entertainment, cell phones, cable tv, reading room and other things. They wont keep VIPs along with pickpockets and robbers.
Most of the VIP frauds actually continue their business operations or start new ventures when in jail and sometimes form new partnerships with like minded VIP frauds who are also in the same prison.
It is a haven for them.
After all the heat goes down and after few years they are released, no one cares - they may either settle in a beach house or continue with another fraud company or maybe enter politics.

I am an Indian National residing in US for the past 10 years.
My labor was filed in September 2006 under Eb3. I received my EAD in 2007 and my current legal status is EAD. Since 2006, I am with the same employer.
In 2008, I got promoted to a Managerial position which requires Bachelors and
minimum 5 yrs progressive experience. I also have a Masters degree in the same field.
I want to port my application to EB2
1. Will this result in me loosing my EAD?
2. What will happen if there is a problem with the new EB2 application - will it also impact the EB3 application?
3. Is it better to change companies to do the porting?
Please advice.

I am not opposing webfax. I am opposing webfax you are sending to promite illegals. These organizations are going to use you to market them self. Secondly nobody is going to read your fax if you even change the words.
Organizations supporting illegals will do nothing for legals.
If you think that by changing the words , you can use their fax to spread your message, then why dont you go to anti-immigrant websites and change their words and send faxes to support legals. You will not do it because you know anti-immigrant is written on top of the fax.
So why do you want to become a puppet of someone else.

Here is one of my friend in the similar situation planning to do. He is filing 485 without any medical exam. Certainly, he is going to get query and after query you have 40 days (double check this number) to reply. So, he'll get some time to go and do wife hunting.
Medical exam is considered part of "intial evidence" for the I485. If your friend files without the medical report, his application will be rejected without an RFE.

H1B petition has dual intent ie immigrant intent on an non-immigrant visa and hence previous filing of I-140 with the previous employer shouldn't affect your new application for H1B.

One of my friend got EAD 2 year back even though his priority date was not came. Ofcourse this was even b4 this mess created USCIS. He was still using his H1 till couple months back, he is afraid of USCIS may roll back his EAD since PD is not yet reached.
I do heared 11 people from Infxxxx company got EAD even though their PD was not current. They are saying by mistake send the package but they got EAD.
I do know personally that person on the 1st paragraph, on the 2nd paragraph I dont have any evidence.....
Just sharing this information to help this thread, hope there may be lot more cases got EAD without PD even before this mess they have created.:D

WHat happens when they return the visa number to DOS? Can they request them again later or these numbers are just wasted for this year?

Since the year is not over yet (until SEP30) , DOS can adjust the dates in next (interim ?) bulletin accordingly. That does not mean they become current like original Jul bulletin did , but at least some people will be able to file.
