One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

U have such a big signature but nothing abt contribution to IV. Have u contributed anything to IV? If not, how do u thinkIV can fight for whatever it is fighting?

He was probably in the point where if we went to India, they would not have let him come back on H1. They paid 10K to get LS (adjusted through employment for 1 year) and when I-140 and 485 were being allowed for consecutive filing I believe Dec2004, filed it. He called me a month back saying they got their physical card. His PD date somewhere 2004 EB3. My PD March 21 2003, am I frustrated of course, but I am frustrated with the system that has loop holes, as pointed out there are hundred of people who have legitimately used LS.. there is no point losing sleep over it.
The need of the hour is this, to be together and fight together, not among each other. IV does not differentiate between LS and non LS, or degrees or anyone's individual cases or scenarios. IV's goal is very simple, GC process should not take more that 2 years and anything that reduces the total time frame, that is what IV stands for. Time is key, lost time cannot be regained, what is in for is now and the future, lets stick together and think about how we can help IV meet this goal, that none of us should be waiting many many more years to come. Can we all agree on this and go forward please?

I have approached Times of India, Rediff and NDTV to have some coverage for this event. I guess the more coverage we will get the more people will respond.
How was the response? I have contacted the following " The Hindu, Deccan chronicle and some telugu and kannada newspapers and TV news channels" so far no responses, I am planning to speak to my dad and his friends (they retired from the news media recently) to get some responses, but whats the point. The July 2nd fiasco was very well publicized in India, rural India too, even a small village or mandal office issuing birth certificates knew abt the visa bulletin and its reversal!!! and what do we have now...non committal friends who are not interested to come to the rally and some even make fun of it!!
Anyways lets keep trying...

Congrats suresh..it's good to see Dec 05 getting approved..best option would be to get your wife here on F1..Some of the schools required only TOEFL ..after coming to US get married again in US and apply for 485..if she is currently working in india..u can try L1 too....ofcourse for H-1B u need to wait for one more year..i don't think US embassy in Chennai will get to know u got married unless she tells them..there is no fraud or anything in this..i believe it's like..don't ask, don't say..ur not cheating anyone..trying to find a small loop hole for a very good reason..

My take on it is that more jobs will be outsourced and only few core people important for a business will retain the jobs and also the salary hikes. This is assuming that offshoring companies mature over the period of time and move up in the service chain in terms of value of services they provide. The current trend is towards translating business requirements here and getting the programming done through some offshoring entity. The preferred vendors are benefiting enormously and so are the companies outsourcing. From a business point of view, technology is an enabler for competitve advantage. So critical and complex projects will still be done here through few core people.
I believe we can survive quite well in the global economy. I am more worried about future of American kids and the education system here. Unless they prepare well for the global economy, America will be in rude shock. Bush is not helping either, dumping the money on wars and creating boats load of debt burden for future generations.

Well they will easily find out from your SSN number if one is on payroll or not. I am seriously looking into this matter of getting illegal and many of my friends agree. Once the bill passes in its current form we should get advise from a good lawyer to convert status from legal to illegal. It sounds so insane when I say changing for legal to illegal..but that is the hit thing these days.

This is what I got from 4 separate lawyers when I was invoking AC-21. I think everybody should speak to a lawyer before invoking AC-21.

AC-21 is pretty complicated and I think that in the future, if there is no change in the law, a lot of 485 applications will be pending for 6-8 years or more. And for the duration of this period, a lot of people will invoke AC-21. I also think that the rate for rejection for number of AC-21 cases at USCIS will be higher. Nobody told me about the approximate wait time and rejection rate. It is just what I think based upon the developing situation.

If you join as a PM somewhere ...you need to be aware of things line earned value, risk register, critical path, management reserves, contract change control system, stages of team formation, types of Org..etc..etc..which is common terminology for PM's..so unless you want to join as a PM and blink you want to get certified..
Most manager jobs require this certification ...like you would go to a dentist to deal with problems with your teeth...not that a general physican cant do it..but a dentist specailises in teeth care..just like it PM is a separate proffession..I have seen MBA getting PMP ceritified..
For a Reason ..among all the certs ...this is the 1st or the 2nd most sought after..in the world..

Have they mentioned it on their website? Usually DMVs like CT etc.. mention on website that they need a Employment verification letter, as a matter of fact, they don't even accept paystubs they just want employment verification letter.
Folks - my advice is : Please do not argue with the department. Ask them to post their new requirement on their website so that you don't go there and get disappointed.
