    When your H1 is ready to be approved, just go back to Canada, get it stamped and enter US using your H1 visa (I-94 should have H-1 stamp)...Thats it, then you are all set...Even after entering on AP, you can continue to work on H-1 if you are still working for the same employer....No need to re-start/re-apply anything...Your EAD/AP will all be still valid but you will be in H-1 status...You can just keep renewing them...The only thing is when you get married and bring your spouse on H-4, you wont be able to file for her 485/EAD/AP till your PD is current again...

    I have nothing against lawyers, most are hard-working and smart. But that smartness also makes them confuse others and ultimately its the clients who have to pay for the smartness of the lawyers.

    I am totally against that.

    making a living is one thing, but talk about confusing people and milking them for the money !!!

    I think we all have this OCD to keep checking IV. I am in EB3 and i know nothing is going to happen to my 485 for the next 3 or more years, i myself keep checking IV, no wonder why you dont want to....

    Atleast be happy that you have a probability that you will get it by aug, think about all the rest of us who dont know what will ever happen and when we may get freed from the clutches of desi employer.....

    May be we should all become afghani translators or get religious visa and apply again in EB4 / EB5 :confused:

    That post was intended towards EB3 category, particularly EB3-India. Ever since starting of this Fiscal Year there are very few EB3-India approvals (Can anybody dispute that?). So how come USCIS used up all the visas already?? Most of the guys here always talk about EB2-India which is not highly effected category in the first place. We suppose to be taking care of effected categories.

    Probably, nothing wrong to discriminate against h1b holders, but discrimination against citizens maybe taken seriously. As such, it is at company's discretion to hire u or not, internally, from what I learnt, if the company decides to hire u, they hire u, if not, they may give u this as a reason because they may have found someone with same skills but without requirement for sponser.
    If a company desperately needs u, they will do anything to hire u. If company thinks it must not have to deal with legal issues and overheads, it may not hire u, may keep u on hold.
    Basically, we are on our own, and we can only try and try. It is the land of opportunities, and there will be opportunities for everyone somewhere.

    should be taken with a huge grain of salt. The job of the media is to create sensationalism so that the news can be spread.

    The general issues still are true.

    Nah, I don't think so. Not a good article.

    1. His salary CAN be raised.
    2. His wife CAN work, as article mentions that he applied for GC in 2004
    3. I never heard about 1 million - I guess we were talking about 140000 unused visas right? Where this 1 million came from?
    4. If the company is bought - one doesn't generally reapply for GC.

    Even little lies don't serve a good cause as this article can be easily discredited.

    We have been living in a county which has implemented 287g for some time. And I believe all legal residents in my county feel safer because of its implementation. Sure, there is a chance that 287g can be misused by the police. But tell me one law which can not be misused by police.

    The thing is that more counties are signing on to 287g. St. Mary's County Joins Controversial Federal Immigration Initiative - Southern Maryland Headline News (http://somd.com/news/headlines/2010/11667.shtml).

    I went thru the proposal in Arizona and could not find even one point which might be bad for us. Did any of you find something? Format Document (http://www.azleg.gov/FormatDocument.asp?inDoc=/legtext/49leg/2r/summary/h.sb1070_04-13-10_houseengrossed.doc.htm). I feel, IV should support such laws. We want the citizens and law abiding people in this country to support us; not the illegals.

    This bill will only lead to profiling!!!!!!!!!!! and never in the world's history has profiling been good. Come out of your "slave" mentality.......... Today these laws are targeting illegal immigrants. Tomorrow what are the chances that they will do the same for legal immigrants? Or are you hoping that you will be a GC/citizen by the time such laws are proposed and implemented and there fore do not have to worry........

    Read some articles that are out there against this bill - you will understand that it takes away resources to fight crime.........wonder if you will feel so safe then or do you live in a gated community?

    As for nothing in the bill that is harmful to us - have you got any idea on how politics works? "You scratch my back and I will scratch yours" Find a single legislator who will take on legal immigration issue, that will not be opposed by the hispanic community and the anti immigrant community (even the ones that say they are for legal immigrants - divide and rule or have you forgotten your history lessons back home)

    come out of your shell and look around. Everyone around you are humans and that is how they have to be treated and not as legals or illegals or hindus or muslims or christians or hispanics or black or irish or whatever else.......

    What you are saying I understand. And many american/GC holders work as independent contractors on 1099. But H1B is never designed for independent contractor (1099). H1B is designed as W2. By using percentage basis H1B consultants are trying to work like independent contractor on 1099. USCIS is trying to crack down on that.

    Who said I am working on percentage basis ? Where did you read that ?

    There are ppl who moved 2 or 3 months after getting GC and have got their USC

    AC21 N400 Cases - 2010 (http://forums.immigration.com/showthread.php?309220-AC21-N400-Cases-2010)

    I went through the entire thread, i did not find any cases of people who had never used AC 21 and who left their employers right after 485 approval.

    To be very specific, we need clarification on what the consequences are of leaving the sponsoring employer right after getting the GC esp people who never used AC21 and have been with the sponsoring company for several years before getting the GC.

    There was a soft LUD on mine as well as on my wife's I-485 :D. Mine was filed in NSC on July 2nd 2007 and transferred to CSC for receipts and transferred back to NSC :confused:. Currently mine is not within the priority date :confused: . Not sure why there is sudden LUD this month :eek:.

    I filed my I-485 (Nov 2004 EB3), but my old labor ( EB3 Mar 2003) got cleared. I am going to apply another labor in EB2 and move this EB3 priority date to that EB2, that way my case will be current.

    Not very much sure about its possibility, any suggestions.

    But coming back to the point, you are in a better boat by not filing, you can atleasr make it as EB2 and get the Green card Faster.
